HI, I''m confused and have some questions? FYI, My husband just received his work permit.

What is a AOS?

Does he need to say that someone is his family is sick to get advance parole?

Our super crappy lawyer who doesn't know anything is very unhelpful. She said we have to pay almost $400 to get it, but I keep reading that on this site that it is included in an AOS

We are trying to go to the Netherlands in dec, is that possible?

If in the USA on a K-3 NO AP needed to travel, K-3 is MULTI-Entry.

If in USA on K-1, then I-131 needs to be filed to be able to travel before getting green-card. NO reason needed to get AP.

AOS = Adjustment Of Status.. Filing I-485 is AOS.

I know I need one. I was just wondering what is the best way to go about this AP. Do I need to have a letter from a doctor saying my parents are sick, which is not true, or could I go other ways as well? How long does it take to get an AP? Does it really cost almost 400 dollars to get one?

No, all you need to indicate is to enable a return trip home while AOS is pending, filing the I-131 with I-485, or filing I-131 with a copy of I-485 NOA1 letter is all that is needed to get AP.

Medical emergency is only for cases where a person applies for an EMERGENCY AP at an info pass appointment directly at their local field office.

I missed your ref about the $400.

NO :no: it does not cost $400, if you file the I-131 with your I-485, the $1010 fee for the I-485 also pays for AP. If you file the I-131 after filing the I-485, you need to attach a copy of I-485 receipt letter (NOA1).

You need to file your AP (I-131) at the Chicago Lockbox ASAP. It can take up to 90 days to get your AP. You only file at your local office in the case of an emergency. For an emergency, you need to prove an emergency (eg immediate relative gravely ill) and provide Proof of the emergency / illness (I had a letter from the DR and they weren't even sure they would accept that). If you file quickly, you might get your AP in time for travel in December. USCIS is indicating that MSC is taking about 3 months to process AP.

You do not have to pay for your I-131, however you do have to include a copy of your I-797 receipt for I-485 which tells the USCIS that you have already paid the fee that includes AOS. You will also have to include photos (even though you sent some with your I-485).

AP wont be handled by the field office unless their is actual emergency, you need to file the I-131 to the Chicago PO box, either with your I-485/I-130/I-765/I-864... OR you file it to the Chicago PO box after filing I-485, and attach a copy of I-485 receipt letter.
