Starting to fill out my I-130 and I-129f forms. My question is which name should I use for my wife. We got merried in C.R. at the end of march but our wedding certificate is not ready until now. She has not done anything to change her last name to mine yet as she has been with me in the U.S. this summer. She will be flying back to C.R. next week to start the waiting process for a K3, in which time she will see about getting her last name changed to mine. Her current passport as well as her expired one with her current VISA in it and every other legal paper at this time has her maiden name on it.

Should I continue using her maiden name on these forms or fill them out with my last name on them and fill in her maiden name under "other names used", as in the example forms.

Always use the current legal name.

Thanks, That's what I thought. Just a little worried it might put up a red flag as to the validity of our merriage.

My wife's name didn't change with marriage. Most people in the world don't change their name when they're married.

Before you argue, remember just how many women are Asian and how many "people" are men. :thumbs:
