My wife's driver's license is expiring in December 2008, but the I-751 approval is not expected until June 2009. We have received the NOA1 and the Biometrics completed. We have the biometrics stamp as well. What do we need when go to the driver's lecense center? Will they cause problem if we give them the NOA1 and biometrics stamp letter? Or do we need to get the I-551 stamp for the license? I guess we will have to get it if she travels to India??? The Indian immigrations personnel at airports can be extremely moody and picky...... :unsure:

Each state has there own criteria... Did you look at your state's DMV website or ask at the license bureau?

My husband was in the same boat and all we did was take the original NOA1, his GC, SS card, Passport and it was renewed for 1 year from the date of the original liscence expiration date.

Definitely check with your local DMV office because in Colorado even the I-551 stamp was not valid. My husband had to have the actual green card in hand to get his drivers license. They will give people a drivers license with the actual EAD card though.

i live in NJ and had my driver's license renewed last year. just follow the usual point ID system (here in NJ-6-point system) and bring your permanent residence card as well as the extension. when i applied, the dmv called their head office first before they issued a new ID. i guess the officer who was in charge of my renewal just want to make sure if it was ok to give me a new one. i presumed that they may have had checked with the uscis first because she was on the phone for quite a while but it was no hassle at all.

as for traveling to india, some say that the expired permanent resident card ID and the extension letter is enough, others said that an i-551 is needed, i think it would depend on what embassy or point of entry you will go through. they said that it will be easier if the USC spouse is with the immigrant when traveling, there are cases that they gave the immigrant a hard time when not traveling with the USC spouse.

The renewal of your ID or license is a easy part that you can simply bring the expired GC amd extention letter to DMV. The new ID or DL will be valid only until the expiration date of the extention letter.

My personal opinion is its not a good idea to travel to India with an expired GC with extention letter because when you are coming back the indian immigration certainly will give hard time. Indian bureaucratic officers don't recognize the extention letter. I heard they even give hard time even if you have the I-551 stamp on your passport. They once said to one of my friend that anybody can make the stamp and put in your passport. They were asking his GC.

One thing is sure that nobody can stop you coming back to US but they will temporarily make you headache. If they denied you have to go back to US counsellat to bring approval letter that will cause your flight delay. My opinion is that don't travel to India with out your physical GC in your hand.
