I am USC and sponsor for my son who older than 21 yrs old.

During the time waiting for process he married and had one child.

Now NVC asked for I 864 and I do not know how I could add his wife and my grand son in his application, so they all can go together. Is there any forms to fill in and submit?

Please help.

What is the priority date on your son's application - when did you submit the application?

I will assume that your son was petitioned in the F1 family-immigration category; unmarried children of US citizens (over 21 who don't qualify as Immediate Relatives). The October 2008 visa bulletin shows that the current priority date for Vietnam is April 15, 2002. This means that beneficiary who had applications filed before April 15, 2002 are eligible for visas if their I-130 was approved.

Since your son is now married, he will be reclassified to the F3 family-immigration category; married children of US citizens. The current priority date for this category is June 22, 2000.

You need to inform the National Visa Center that your son is now married and has a child, and that you would like them added to his application. It's better to wait another 2 years, so that his entire family can immigrate to the US together - legally.

I know some Vietnamese in Orange County who have divorced and come to the US as single people. They would then do a fiancee petition or go back to get remarried to their spouse. This additional process takes 2 years. You will also have to spend more money. However, the risk is that it is fraud and everyone may get deported. DON'T DO THIS. WAIT THE 2 ADDITIONAL YEARS.
