So after my fiance & I get married (which will be 2-3 weeks after he gets here)...does his visa still expire after the 90 day mark? I noticed that AOS takes a while & was confused as to if we were supposed to get everything done (before the 90 days are up). Or does our marriage extend his legal status a little longer until AOS is done?

sorry if this sounds silly, but thats they always say about me. :whistle:

p.s. i tried to read up on it, but my brain is too frazzled tonight to understand anything. :wacko:

The K-1 visa is good for one entry, it is void as soon as he is admitted to the US. The I-94 is valid for 90 days. You must get married within the 90 days to comply with the terms of the visa. You can apply for AOS after you are married, but it doesn't have to be within the 90 days. It is to your advantage to appy for AOS as soon as possibe so you can get permission to work and advance parole if desired while you wait for your green card.
