Hello!

I'm still trying to collect evidence for my I-751 now. I've read the instruction of the I-751again. I'm wondering is "Lease or mortgage contracts showing joint occupancy and/ or ownership of your communcal residence (Point #2 under Evidence of the Relationship) a must. It seems to me it is important. But the house was bought under my husband's name a few months I came here. I did find a mortgage contract that my husband speficied that he was married. But then it was blank under 'dependents'. And my name is not on any of the home puchase documents except it can show that he's married at the time. So do I have to include the mortgage documents?

Thank you for your help!

Joint ownership of a home is only one of several different kinds of evidence... You cannot provide what you do not have... concentrate on what you have

YMMV

fwaguy,

Thanks for your fast reply.

I think I read in one thread that it is better to prove that it is really our place, and it being my husband's place without my name doesn't matter. I'm just not sure about it. I bascially have most of the evidence except for the tax transcripts (still waiting for them in mail) and the affidavits from friends. So I really want to know if we need to include the mortgage document. Also in my previous thread, I was told that I should include that document but I can write an explanation about why my name is not on it.

Did anyone include their lease/ mortgage document in the application even only 1 of the names are on it? Any more suggestions? Thanks!

So far I am considering not including any information pertaining to our mortage. Our house was purchase before my husband (Fiance at the time) arrived in the USA. Since his arrival I have yet to add his name to our mortage, or even change my name from maiden to married. Nevertheless, we do have other documents showing our joint accounts, and same address. Therefore, I think  the best thing is to not include the information. As others have mentioend before, focus on what you do have. If my response is incorrect, someone please let me know.

Thanks.

Being added to the ownership or mortgage of a home is not critical. We just received our approval and the home and utility bills are all in my name, not my wife's. They really look for lots of ways to prove you have a marriage. Home ownership is one way, but not entirely everything. You should show joint bank accounts, joint credit cards and if available listings of the non US resident being the named beneficiary on insurance policies or retirement accounts.

Remember, they are looking for financial commitments to each other as evidence of a true marriage. So focus on those things that you can prove and trust that it is enough. Just remember you do need to show some joint ownership somehow.

We did not include the mortgage or deed to our house either. My husband owned this house before we got married, has a really good mortgage rate and doesn't want to re-finance in order to add me (I agree), and since Georgia is a joint property state already paying money to add my name to the deed isn't necessary. I included this information in a cover letter with our I-751. I also indicated on some of the joint bank statements that I included where the mortgage payment for the house came from our joint account. There are other documents you can use that prove your joint residency. Although mortgage/deeds are good evidence they aren't necessary if you have other good examples as well.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Hello!

Thanks for all your replies. So I guess it is not a must providing that I have other evidence of joint residency ( like joint bank accounts. bills, visa cards etc.). I think I will not include those since i think it doesn't really prove anything. :) Thanks a lot for your help!

if you have bills for the same address, insurance etc showing the same address thats just as good... everyone understands that changing mortgage titles, refinancing etc is not so fun, easy or the best idea sometimes, but does not mean it;s not your home... you could even have your husband make a will, placing you as beneficiary of the home. But you don't need your mortgage to prove your case... just put together everything else you have.
