Can AOS be denied?

I am a K3 filer and am undecided about whether I should go with the K3 route or the CR1 route once I get my I129F and I130 approvals.

Besides K3 route being more expensive as compared to CR1, is there a chance that my adjustment of status application can be denied after arriving in the US on a K3?

K3 Visa

Service Center : Vermont Service Center

Consulate : Islamabad, Pakistan

I-130 Sent : 2008-01-22

I-130 NOA1 : 2008-02-13

I-130 Approval : 2008-09-08

I-129F Sent : 2008-03-03

I-129F NOA1 : 2008-03-04 (Received in post : 2008-03-18)

I-129F NOA2 : 2008-09-08

NVC Received : 2008-09-15

NVC left: 2008-09-16

Embassy received: Around 2008-09-23

Package 3.5 received: 2008-10-08

PAckage 3.5 sent: 2008-10-09

Medical: 2008-11-10

Interview date: 2008-11-24

Date of entry into US: 2008-12-14

Yes an AOS could be denied if the AO felt it was not a genuine marriage or you have little or no evidence of a genuine marriage or you failed to return any paperwork in a timely fashion or any other reasons that USCIS have for refusing an application to adjust status.

why would you be worried about that? :blink:

If it wasn't something that happens, there would be no purpose in going through the adjudication process. Instead, there would be green card issuing stations at airports instead of a USCIS and DOS visa process.

I'd say with a K3 visa in hand, you're better off with AOS than going back for a CR1 Consular interview.

Facts are cheap...knowing how to use them is precious...
