Hello everyone hope everyones journey is going well. Ok here's the storey my bro get engaged and things aren't working out.He brought his fiance from Afghanistan and going back will make things worse. can i apply for asylum for her in hopes they can patch things up.Thanks VJer's

You might assist her in filing for asylum but not file for her.

Hi asylum is not an easy thing to prove and if they think you're doing it to gain any type of immigration benefit this person can receive a lifetime ban. One more thing, if you're going to file for asylum, I believe it has to be done within a year of entry into the US or a time bar issue will come up and that will have to be addressed in immigration court (if it reaches that far).

She....supposedly came here to marry this other guy.....and....now...what....she's...not going to marry him? If she isn't going to fulfill the purpose she...supposedly....came here for, then why wouldn't she go home? Ooohh, yeah, that's right...the repressive regime problem. Sure that's not why she came in the first place? If I were USCIS - you'd have to work awfully hard to prove to me otherwise.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

Not if she entered on the K-1. She would have to return to Afghanistan and either pursue another K-1 or marry and pursue a spousal visa to return.

Not if she entered on the K-1. She would have to return to Afghanistan and either pursue another K-1 or marry and pursue a spousal visa to return.
Yes, she can marry the other man, while she is still in the U.S. However, she will still need to leave the country before her 90 days is up. Then her new husband can petition for a spouse visa for her. Edited by akdiver

Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

That was the name of the unit I worked in as a bill collector. The gave if that name because we were able to track down and extract money from people who seemed to have disappeared - like a ghost.

With agood lawyer, she can apply for asylum. Although she came here as a K1, she can apply for asylum if going back to her home country will put her in danger.

i know of many cases who got here and then sought asylum successfully. However, the applicant has to be from a hotspot like Afgan or Iraq etc.

Wow, she already met another man to marry? She works fast! It took me a year before I decided to marry my husband.

Sorry no advice on the subject, its not my area, but I am curious, is your brother an immigrant as well, or was he (and you) born and raised in the US?

I understand the situation, I think....if it was arranged and she now goes home, "divorced" it could be a serious problem for her and the families involved. Was there dowry exchanges between families????

The problem is that she does have to go back to her country of origin if the K-1 did not work out. If she can show PROOF (hard proof) she will face iminent harm going back, then maybe she can get assylum.

This is a question for a immigration lawyer who specializes in refugee work.

My bro is a citizen, and saw how my marriage was arranged and worked thought he could do he same, but it didn't work out. I think i have a good case because of the area being a hotbed for uneducated mullahs who think they know everything and may want to apply their own justice. What u think?

Well, using this logic, any woman from Afghanistan or similar places can get a K-1 visa, forget about getting married once she gets here, and get asylum - thus making the K-1 a defacto asylum visa. Does this make sense to you? The U.S. can't be responsible for the local culture in these places (no matter how hard it tries). If a woman doesn't want to face that risk, she shouldn't apply for the K-1 in the first place. Were I in the govt, I'd send her home for sure.
