We did DCF in Brazil, and my husband has his interview coming up within the next few months. What we would like to know is:

after his interview, once he gets his visa stamped in his passport, can he come visit for 1 week and then return to Brazil in order for us to look for a place to live together and for him to have a couple of job interviews? Can he return to Brazil before his actual Permanent Residency card and SSN have arrived? Will he be able to come back to the US afterward, or will I have to take or mail the cards to him?

He is worried about just simply quitting his job and moving here without any prospects, and I cannot support the both of us while he is not working, so he wants to just visit for a week, and then actually move here a little while later.

Any help is appreciated! Thanks!

after entry he will receive a stamp in his passport that will act as a temp greencard... he can work and travel as any greencard holder can. Just need to be aware of how long he will be outside the country after he arrives ....

:yes: YES.

Upon entry to the USA the CR-1 visa holder will get an I-551 stamp in passport, this makes passport act an a temp green-card, alowing work and return from trips abroad.

As fwaguy said, make sure he is not outside the US for more than 12 months, I say 6 months to be on the safe sife, or Immigration will give him a hard time when he gets back. After 12 months he will most likely lose his residency.

Yep to everything everyone said so far. I would stress that mononoke's point about only doing six months or less to be on the safe side. More than six months will cause quite the grilling at point of entry upon his return.

You said you did DCF but it sounds like you're already in and the US or will be when he gets his visa, right? If so, that makes it easier and better because the greencard and SSN can come safely in the mail to you in the US. He doesn't need them to return though - the stamp on the visa in his passport is good for one year. If you'll be in Brazil with him though make sure you have a US address to use - a friend or family member you trust.

Thanks to everyone who replied! These responses have given us some peace of mind about this.

We did do DCF, but I moved back to the US about one month afterward (sadly) to get back to school to start a Master's. So, it won't be a problem to get his Green card and SSN card mailed here to my place.

I can't wait for this all to be over!

Um, nowhere. I was just responding to MargotDarko, as she suggested having it mailed to a friend or relative if need be.

If so, that makes it easier and better because the greencard and SSN can come safely in the mail to you in the US.

It was a statement, not a question.

We had made a visit to US and headed back to India just few months back.

We are plannig to head back in December (hubby's visa stamp is only valid for 6 months)

During our course of stay (one month) we did not even receive a welcome letter from the embassy. Our case is still pending, and the customer service executives are not able to provide any further information than what is provided on their website.

We had entered US on July 27. The texas centre received our application on August 4. If we do not received/hear anything from the USICS by October 20 (aprox 75 days) we would be heading to States to find out exactly what is going on..

Do not want to scare you, but make sure you have family based in US to update you with the information while you back in Brazil

In our case, I already have moved back to the US and have no current plans of moving back to Brazil, so I will be here to receive any and all correspondence, as well as make any phone calls if need be.

How is your case still pending, if you already have approval for your visa?

Yes, I'm curious as well what she means by the case still pending.

If he gets the visa and has no problems entering the US, you have nothing to worry about. Nothing will be pending. The green card takes about six to eight weeks to arrive, but the stamp on the visa in the passport is all he would need to return to the US.

You need to be very sure about what you would do in US. The US economy is going through a meltdown and its tough to get work. Don't quit your current job just yet.

Wow. That is really crazy and I had absolutely no idea it was even possible. I have never heard of anything like that happening. I can't advise on the situation itself, but when you say the stamp expires in December, I am guessing you mean that's the date on the visa. He had until December to enter and activate the visa. He now has temp green card status for a year from the date of activation - so until July 26, 2009. He'll showed the stamped visa when he returns, and if they ask why he doesn't have his physical green card yet, then you explain the situation.

EDIT - I would repost your original post about this situation but this time give it a heading like - "Received CR1, entered US in July, USCIS requested biometrics and case is pending" to get more attention.

No additional stamps after the US Visa Sticker of CR 1 visa

"He now has temp green card status for a year from the date of activation - so until July 26, 2009."

NO temp green card either, we have a sticker of I-551 which expires in December
