What are the regulations on this?

Okay guys, I have some questions and I really hope you can help me find the answers. It's pretty urgent.

I got to the US in November 2007 and have a 2-year greencard. Now I have to leave the US for an uncertain amount of time (could be 3 month, could be a year) due to personal reasons. What do I have to do to keep the greencard? In 2008, I was already out of the US for about 2 months total, and I am planning to leave the US this month.

So what do I do? Do I have to apply for a reentry permit? How long can I be out of the US without having to apply for one?

In the worst case scenario, could my husband and I file for removing of conditions (to get my 10 year greencard) in July 2009 while I am in my homecountry?

Please answer soon, it's urgent.

Hi Jasmin,

You can't be outside the US for more than 12 months. If you think you will be out for more than that, you can file for a re-entry permit that will let you stay outside of the US for 2 years. You have to file and have it approved BEFORE you leave, can't file from overseas. If you stay out for more than 12 months, they might take your residency from you and you'd have to re-apply.

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Okay, I see. But I think I remember reading somewhere that I would have to apply while I am still in the US but wouldn't have to wait until it was approved. You said something different. Which statement is right?

If I want to apply for a reentry permit just to be safe, which form is it?

And, does the 12 months start from the day I leave the US?
