ATTENTION ALL VISA APPLICANTS!!!!!

If any of you are looking for a K1 or K3 visa attorney to help you with any forms etc, do not use the lawyer Calvin Knickerbocker of Sagaria law. I hired him as my visa lawyer and payed him $500, and he never completed my visa I had to do it myself. So he took $500 for nothing and wont pay me even part of that money back.

OMG!!! I nearly fainted when I saw this thread. If he is the same Calvin Knickerbocker from Oregon then he IS the lawyer my fiance hired for our K1 visa. We have filed, I believe, last month September '08 so we are just in the first stage of the process. What should we do?!? : :(

We are confident in our ability to help you obtain your visa. If your K1 visa petition is not approved by the USCIS, we will refund our legal fee or appeal your case for free if we determine that there is merit to appeal the K1 fiancee visa.

Its “Money Back Guarantee” IF your K1 visa petition is not approved. But this does not necessarily mean that you are able to get a refund if you are unhappy with their service. It is very common for legal services, especially immigration attorneys to advertise a “Money Back Guarantee” but ONLY if they file and your case was not approved or alike. An alternative option they may give you is that if you no longer want them handling your current case, they will use the money paid as a credit toward another service (provided by them) that you may have in future.

Depends on how your retainer letter is written. If it's a flat fee, and they've already started the case, you may be SOL.

If it's a retainer against time worked on your case, you may be able to get back some of the money...but don't be surprised when you see fees for 1 minute phone calls billed at 1/4 hour...and so on.

OMG....

I just looked at this guy's site.

In my opinion, all he's offering to do is read the instructions to you for $500 to $1000 bucks.

I don't see anything listed in the services, that you can't get from the guides and advice on VJ.

Maybe I'm missing something, but the only service I see him offering is to reduce the total of your bank account,

and as the OP mentioned, most likely delay your case over what you could do yourself.

I know most of that have BEEN through the process, probably know more about it, and are more passionate

about it than most immigration attorneys...too bad we can't get paid for helping each other.

There's some really great folks here that would be rich :)

Read your contract with him, if it states flat fee to do this or that and he has not performed the duties that were regulated in that contract, contact the bar association in your vicinity and file a complaint.

he is our attorney take a look at our time line that should tell u something about his service......he charged us a little better than six hundred dollars to stuff the envelope with the documents we filled out and sent to him and send them off.........he does not answer calls very well or return emails........i have asked him to do many things to try to resolve our case including all correspondence he claims to have made concerning our case i received only copies of what we sent to him......i asked him if we should make info pass he stated it would be useless (he might be right about that) but we are now trying to build a case to take to fed court on our own to push csc into doing their job either approve us for noa2 or deny us.....with out anything from him it is really hard........we have on our own contacted senators and congressmen he claimed two weeks ago to have contacted a congressman on our behalf ...........when he filed our papers if he had done as we asked make a cover letter i feel we would have been approved if i had ran into vj before hiring this attorney i would have known i didnt need him...and could have made a cover letter to point out and answer anything that i felt at the time might be a problem.....he contacts me at times and tells me he is not sitting idle doing nothing on our case but to date i have not seen an proof of anything he has done and in most cases i give him the updates on our case a few weeks ago he told us our case was in the red room what is a red room nobody seems to know i found out later something completely different...........and yes he is from the state of oregon was one of the reasons we hired him because we felt we should hire someone that is closer to us..........and im pretty sure he comes and reads the post here on this forum as well anything to do with immigration he reads he contacted me the same day my story made it to the albany paper he lives near portland so no reason for him to even look at that news paper.......in that article i pretty much fried our congressman that refused to help us until after we had waited one year....i think he was trying to make sure his name didnt make it in print as well would be bad for business..........we filed our papers one year ago this past aug.......receipted sept 24th last year and to date have not received noa2

My fiance decided to hire a lawyer to avoid mess ups that we thought may cause delays and that was long before I learned about VJ website. I told the lawyer I am starting a timeline journal yesterday and asked for some details and he said he sent our papers to California Service Center and that it was sent last September 22. So, for now I guess we are 10 days into waiting for NOA1. Knickerbocker has been prompt answering my inquiries so far. He has already been paid full for his services and so we are just hoping for the best for now.

It helps that I am learning a LOT about the K1 visa process through this website so that we cannot just totally rely on him. Thanks VJ and more power!:)

p.s. fiance said his cheque has been encashed. we are keeping our fingers crossed.

see i thought if u hired an attorney they are the one that is suppose to be the advocate for ur case if u run into trouble....so far and i cant say if he is or isnt but he does not seem to be as informed as we are over our case........i believe if several people are unsatisfied with the service u provide it is in the best interest of the company and the client for them to work on the cases they have already been paid for and to satisfy those clients before taken on a ####### load of other cases....in my work that i do i work out any problems that any client may find with the work that i do......word of mouth travels far in the type of business u r and how u conduct that business sweeping problems under the carpet and hoping that either the client can rectify it or it rectifies itself is no way to run a business of any kind...........waiting a year for simple k1 visa......and being told wait wait wait and no i dont know what to do is not in my opinion advocating
