Hi everyone,

We are applying for my AOS and EAD most of the questions on both forms are answered but we are confused on what to answer on I-765 # 16. What is the difference between the © (9) and (a) (6)? To all the k 1 who applied for their I-765 what did you all answer on # 16?

The difference will be when the EAD expires. If you are submitting the I-765 alone then it is A6 and the EAD expires at the same time as your I-94. If you are submitting the I-765 with or after the I-485 then it is C9 and it will expire in 1 year from issue. For you since it is in conjunction with AOS then it is C9

USE (C )(9 ) BASED ON PENDING I-485. This the EAD that is included in the fee for I-485.

If you use code (A )(6 ), this generates a 90 day EAD based on K-1 entry date, and fee is $340, this is a worthless EAD, because it can take up to 90 days to get, so in most cases expires BEFORE USCIS can issue it, or it expires very shortly after it is issued.
