Initially, I filed with an attorney in the USA for K3 and then found out about DCF. We visited the Embassy today and filed here, but they told us to withdraw the I-130 in the USA. I tried to contact the USCIS, but can't seem to get to an actual person on the phone.

Does anyone know how to withdraw or do get ahold of a person at USCIS instead of the automated system?

Your help will be appreciated!

You need to do it in writing. Send a letter to the service center handling the pending I-130 requesting it be withdrawn.

Is now a US Citizen immigration completed Jan 12, 2012.

Thanks:) We haven't recieved an NOA yet, so I'm not sure which center it was sent to. Also, do you think this will raise any eyebrows here at the Consulate? The officer said it was no big deal, but just want to double check.

Do you mean will withdrawing the first I-130 raise any eyebrows? It definitely shouldn't. The reason for withdrawal (getting to file by DCF) will be very clear and understood. Anyone who had the chance to do it would do it. :)

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
