Yes you are correct, if you are filing the I765 concurrently with I485 (AOS) you do not need to pay the additional fee for the I765 only the $1010 for the I485+biometrics.

Special Instructions :

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

The $1010 fees includes all 3 associated applications >> AOS + EAD + AP;

I got a puzzled and thus thght wd write .... my husband is doing AOS from B1 visa and i thought he has to fill the following with the the following costs :

I-485 ( foreign citizen )- $1010 ( including $930 plus a biometrics fee of $80 )

I-130 ( for usc ) - $355.

I-765 (foreign citizen)- Included in the cost of I-485

I-131 (trvel doc for foreign citizen ) - Included in the cost of I-485

I-864 or I-864EZ ( for usc ) - no fee

g-325a ( one for usc and one for foreign citizen)- no fee

I-693 (medical exam for foreign citizen, filled out by an USCIS civil surgeon) What ever the Civil Surgeon Charges...

Am i right ? or am i doing some wrong ?Is I-130 is necessary for us ?

ii) To whom shd the cheques be written to and how many cheques to make ?

Christera-I'm sure someone with more experience will jump in, but I believe you are correct. You need to pay the $1010 for AOS/EAD/AP and send a separate check for $355 the I-130.

thanks Aravis ....ya i want to get more confirmed whether we need the I-130 or not as because here in Visajourney Adjustment of Status forms area it does`nt mention about the I-130 ..here is the link LINK

That is because the AOS guides here on VJ are geared for people who came here on a K1 (fiance visa) or K3 (spousal visa), in which case the I-130 is not needed. If you did NOT come here on a fiance/spousal visa then you are required to file the I-130.

If I file I-130 and I-485 together for my father that currently live in the US. I need to include the $355 for I-130 or the $1010 is enough for the whole package?

If you are filing I-130 at the same time as I-485, you need to pay separately. Two checks, two amounts.

I-130 - $355

I-485 - $1010

and yes, H1 visa has to file I-130 for family based visa (i.e. marriage based greencard application)

I just sent my AOS package but only include the $1010 fee for I485. I forgot the I 130 fee. So is there anyway I can send additional check to the USCIS or do I have to wait for the RFE come and then I can send the check to them.
