Has anyone applied for the DV lottery while they are stuck in visa h-ll ? The entry period is open and I was wondering as it is free to enter if it might be faster than the litigation mess I am going through.

As for us no, because he would eventually get stuck in the same place he is now.

I think it is better not to do the DV while waiting. Just gives the CO another issue to fuss about and as I said we would get stuck in the same place.

Where is your case now Sylvia ?

Mark Ellis is working on it , I just tend to be the type that looks for every possible path. I have reported the embassy to DHS and the civil liberties group so we will see what happens.

there is NO harm done in applying for the dv lottery while going through the visa journey

(when I find the correct jargon I'll post it later). they have nothing to do with each other.

and remember it IS a LOTTERY, the chances of actually winning/being selected is a about as good as you winning the power ball in a foreign country.

either way, can't hurt, can't help.

If I remember correctly they draw roughly 100000 entries out of almost 1 million entries. However they use those to get 50000 "qualified" winners.

My husband is going to apply for the DV even though we basically just sent in the AOS. Because of our given situation, it is, at least, worth a shot.

BTW, good afternoon, everyone.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

DV Program

The Congressionally mandated Diversity Immigrant Visa Program makes available 50,000 permanent resident visas annually, drawn from random selection among all entries to persons who meet strict eligibility requirements from countries with low

rates of immigration to the United States

For DV-2010, natives of the following countries1 are not eligible to apply because the countries sent a total of more than 50,000 immigrants to the U.S. in the previous five years: BRAZIL, CANADA, CHINA (mainland-born), COLOMBIA, DOMINICAN REPUBLIC, ECUADOR, EL SALVADOR, GUATEMALA, HAITI, INDIA, JAMAICA, MEXICO, PAKISTAN, PHILIPPINES, PERU, POLAND, SOUTH KOREA, UNITED KINGDOM (except Northern Ireland) and its dependent territories, and VIETNAM.

HOW MANY INDIVIDUALS WILL BE SELECTED?

There are 50,000 DV visas available for DV-2010, but more than that number of individuals will be selected. Because it is likely that some of the first 50,000 persons who are selected will not qualify for visas or pursue their cases to visa issuance, more than 50,000 entries will be selected by the Kentucky Consular Center to ensure that all of the available DV visas are issued. However, this also means that there will not be a sufficient number of visas for all those who are initially selected. All applicants who are selected will be informed promptly of their place on the list. Interviews for the DV-2010 program will begin in October 2009. The Kentucky Consular Center will send appointment letters to selected applicants four to six weeks before the scheduled interviews with U.S. consular officers at overseas posts. Each month, visas will be issued to those applicants who are ready for issuance during that month, visa-number availability permitting. Once all of the 50,000 DV visas have been issued, the program will end. In principle, visa numbers could be finished before September 2010. Selected applicants who wish to receive visas must be prepared to act promptly on their cases. Random selection by the Kentucky Consular Center computer as a selectee does not automatically guarantee that you will receive a visa. You must qualify for the visa as well.

I want to stress that you will be going through verification with a DV lottery win as well. It is not as easy as winning a lottery ticket and jump on a

plane.

If you are accused down the road during your K1 or K3 interview of seeking benefits for immigration purposes only, then a DV does not look so good.

Careful, we are dealing with irrational CO's who throw a lot out there during interviews. I personally would not play the DV during this process.

We are not going through Europe folks ! Whatever we do will be very closely looked at and interpreted according to the CO and is definitely

not always correct.
