Hello fellow VJers.

I have a quick question on I-864, Affidavit of Support.

My question is ... Do we need to notarize it as we did for K1 petition? :blink:

10/09/2007: Sent out I-129F

07/31/2008: K1 visa issued

08/05/2008: U.S. entry as a K1 visa holder

09/03/2008: Wedding at the City Hall:)

AOS timeline

09/18/2008: Sent out AOS/EAD/AP via Fedex

09/22/2008: Application received

09/26/2008: Application received Date on NOA1

10/16/2008: Biometrics appointment

10/17/2008: Touch

12/08/2008: Filed a Service Request for EAD (more than 75 days since petition received.)

12/22/2008: Infopass Appointment (Day 91 since EAD application filed)

12/22/2008: EAD approved (card production ordered/Day 91)

12/31/2008: AP received in mail :)

01/02/2009: EAD received in mail :)

01/09/2009: AOS interview letter received in mail :)

02/20/2009: Interview :) => Approved!!!!!

We dont need to notarized it, just fill it out...

Lifting Condition:

Sent : Oct. 12, 2010

Received NOA1 : Oct. 14, 2010

Biometrics REcvd : Oct. 29, 2010

Biometrics Appnt.: Nov. 15, 2010

Your first indication of a notarial need is locating a place on the form for the notary to sign. Look at the I-134 and then the I-864. You will see your answer.

PER USCIS:

Some editions of the Form I-864 and Form I-864A include a jurat to be completed by a notary or by a consular or immigration officer to show that the person signed or acknowledged the signing of the Form I-864 or I-864A under oath. The Form I-864 and Form I-864A, however, provide that they are signed “under penalty of perjury.” Thus, 28 USC 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

Since we received RFE for K1, we are kind of paranoid and want to make sure of every little details....

We are almost done with assembling docs for AOS.

The person filling out the I-864 (US Citizen/Spouse) Signs the I-864, IT dose not need to be NOTARIZED.
