Hello all. I need a little help, not sure of what I need to do. I am the US citizen who petitioned for my spouse to come here. After a couple of years of abuse, I found the strength to get out. I recently had my spouse arrested, with an order of protection from myself and our children.

Can anyone suggest what kind of divorce packet I need to fill out? What I can do to free myself from the immigration process. I'm feeling a bit overwhelmed and want to go about things the right way so any suggestions would be greatly appreciated. Below you will find where we are in the immigration process.Please if someone can explain what I need to do so I'm not financially responsible for my spouse anymore, I would greatly appreciate it.

Divorce will differ from state to state. Best advice is to consult with an attorney - often the initial consultation will be free and they can advise you to your specific situation.

My spouse is facing felony charges, if he is found guilty, won't he be faced with deportation?

Possibly. Deportation would end your financial obligation until or unless he is able to legally return.

I have always wondered how do you know if they have worked 40 quarters of work? Does a quarter = 3 months?

Essentially, yes, as long as the alien makes the requisite social security deposits from wages. The SSA will keep track of the quarters where an alien has earned enough and paid enough social security tax. However, in the case of an alien that has been married, and been credited for his spouse's social security deposits as well, it is important for a determination to be requested by the alien from the Social Security Administration before divorce occurs, as upon divorce no credit will be afforded the alien for his US citizen spouse's work.
