Timeline

Can anyone help me with this. We just got our approval a couple of days ago. Now, I think we are in trouble for the Affidavit of Support. He is earning way over the 125% of Poverty Line. But the dilemma is this. He resigned from his work over a month ago, he has another job but he wont start until October. This has been the only time that he has gone jobless and its only for a month or 2, my question is, is that going to affect our application? He would be able to produce his past income tax return, he would also be able to produce an employment certificate with his previous job. We are just concerned because he doenst have a job right now, and we would want to set our interview date as soon as possible. We felt that we have been away from each other for too long now.

Please I would appreciate it very much if somebody could enlighten me up on this. All your posts would be highly appreciated.

Personally, I wouldn't chance it. If they ask if he's currently employed and he lies, you're setting yourself up for a much much longer wait should they deny the application. If you can't wait till October, maybe see if you can get a co-sponsor?

i know someone who got same situation as yours..

petitioner lost the job before they received noa2..

petitioner was accepting pay from previous job tho..

something like a pay since the company laid him off..

it went smooth with their process..

i suggest u go on with your process since he'll start to work oct u said..

i think it wont affect the process.. that's just my opinion tho.. ;)

If he has another job set up for October presumably he has a contract with them? Can't you get a letter from his new job stating what his salary will be and when he will start. This coupled with tax returns from the past three years and any pay stubs he has to show evidence that he was recently employed would be good evidence he has the means to support you. He could also include proof of assets or savings to supplement the mandatory evidence.

Nope he doesn't have a contract with his new job. He just had his interview the other week and luckily he got the job. So do you think that getting a co-sponsor would make everything easier?

We consulted an attorney about it, the lawyer said that if you have enough savings and can show a bank acct that shows enough for the AOS.. it shouldn't be a problem..

I'm not sure you can even use a co-sponsor in PI. You will want to check with the sherriff over there. ;)

If he can provide his tax info and a letter from the new employer you may be ok. Also, as mentioned above, assets can come into play but they will need to be liquid assets (easily transferable) and x3 for every $1 short of income.
