grrr...question about medical

I have done some reading on the forum and USCIS website about medial requirements when applying for AOS.

I came on a K1 visa and did medical in home country without the new requirements (no TB skin test, only chest X-ray).

Now before i file all docs do i need to go to a civil surgeon and have it done? or just file everything and wait for their reaction?

How does the vaccination thing work?

I read that although medical was done i still need to file first part of I-693 and civil surgeon has to fill vaccination supplement...??????? Is that correct? Or is it ok if i only send a copy of the vaccination document the panel physician gave me at the time of medical (that says "to use with DS-2035")

Oh God...i hope i get to the bottom of this soon...

Thanks for replies!

You need to have a vaccination record from home country, or get the age specific immigrations vaccinations or immunity tests done in the USA, they can be done by county health dept, clinic, hospital, doctor... You get this record transferred to an I-693.

I had to deal with a similar situation with Civil Surgeon, I simply brought the directions for I-485 and pointed to the instructions about vaccination supplement for K-1.

A full medical is NOT required, all you need to do is download I-693 and point out the directions.

A full medical is NOT a requirement for AOS from a K-Visa only the vaccination part of I-693 is.

Recently USCIS has updated form I-693 with updated directions for Civil Surgeons explicitly explaining that ALL K-Visas do not need a full physical.

I-693:

2. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e), or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen, and

C. You received a medical examination prior to admission, then-

a. You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination.

b. You will, however, be required to complete Part 1, Information about you, and submit the vaccination section of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5, the Civil Surgeon's Certification.

http://www.uscis.gov/files/form/I-693instr.pdf

And form I-485 directions have this:

8. Fiancé(e)s.

If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement, not the entire medical report. You may include the vaccination supplement with your adjustment-of-status application.

Yep, the only persons not needing I-693 are people NOT adjusting status like CR-1/IR-1 IMMIGRANT visas, they need vaccinations done BEFORE they can get their visa.

Hi Aleena,

i'm adding to your thread because i have the same question...

So if our SO came over on a K1 visa, he/she still needs to see a civil surgeon, yes?

i don't know why i didn't pay attention to this before... i thought we could just send in his vaccine record and his chest X-ray?

a. You are not required to have another medical

examination as long as your Form I-485,

Application to Register Permanent Residence or

Adjust Status, is filed within one year of your

overseas medical examination.

b. You will, however, be required to complete Part

1 of the I-693, Information about you, and submit the

vaccination section of Part 2 with your

adjustment of status application. A designated

civil surgeon must complete the vaccination

section and Part 5, the Civil Surgeon's

Certification.

My questions are: Can you go to any doctor to do this? Can we just go to Dept of Health?

And also: Where do you get the DS 2035 form?

Thanks!

YuandDan gave you what is required. You are required to visit a "Civil Surgeon" who is supposed to copy the vaccination info from your DS-3025 (or 2053) you should have received from the doctor who did your medical onto the I-693 medical form. But many CS's are not willing to do that. They will try to convince you that you need a full medical again for various reasons. That's bullsh*t, you don't need a medical if you had it within 1 year of applying for AOS. Some charge up to $400 for a full medical/bloodwork.

However, there have been a handful of people who have just included a copy of the vaccination worksheet they received at their medical oversees, and have been approved. That would be the DS-3025 or DS-2053.

My wife and I sent in her AOS in late July with just the DS-3025, and we haven't received an RFE yet. It may still come but so far, so good. If it comes we'll deal with it. Others are doing the same thing. If an RFE is issued it will slow down your process by a couple of weeks if you respond to the RFE quickly.

So now you know what you are required (technically) and what some others have done and been successful. It's your choice.

Thanks, Kid Brooklyn!

i have to look at the docs we have already at home...

A more pertinent question for us is... For example, if you receive an RFE for the medical...

Will that effect your EAD application?

Or is the medical strictly for AOS, and the EAD unrelated...

(For us, the EAD is really important...we can be patient about the AOS)

Thanks again,

hz

You may or maynot have got form DS-2035 while overseas during visa medical, K-Visas are non-immigrant and in most cases wont get DS-2035.

You can get tested and/or vaccinated by any doctor, however ONLY a Civil surgeon can transfer the records to the I-693.

Thanks guys!

Everything is much clearer now!

So i can just sent my vaccination supplement and hope we won't get an RFE or be safe and go to a civil surgeon and have it transcribed.

Most likely i will have to have a TST too since the new regulations... And i am pretty sure they would issue a RFE just for that.

So I think i will go to a civil surgeon and have it all done with!

Hi, my fiancee had her medical a couple of days ago, but the doctor did not give her a DS-3025 form. He only gave her a big sealed envelope with all the test results and the chest X-rays. What are we to do in this case? How do we fill out the I-693 form since we do not have a DS-3025 for the civil surgeon to transfer all the vaccination records? Thank you in advance for your answers.

She needs to go back to that doctor and get one ASAP. The doctor may need to open and then reseal the envelope since he probably does not keep copies of these things in his files. Otherwise, she will have a problem proving which vaccines she already had.

If you get an RFE for the medical, does this effect your EAD application?

Thanks again!

I really do not think it should affect your EAD since you can actually file for EAD before marrying while still on K1.

Some people say that an RFE halts the WHOLE process (AOS, EAD, AP), while others say that they have received EAD cards while preparing a response to an RFE. The CIS is not consistent. GO FIGURE!

Hi.

Please see page 4 of the I-485 instructions which state that one is supposed to submit an I-693. They state that someone who entered the country on a K-1 visa does not need to redo the medical, just the vaccination section of the application.

http://www.uscis.gov/files/form/i-485instr.pdf

Here's a link to the new regulations...
