EAD Approval Question

Hello,

I checked my case status this morning to see if there was any news...and my EAD was approved! The message says that my card will be mailed shortly. I already have a job offer, and they want me to start asap. Can I start now, since my application is approved? Or...do I need to wait until I get the card? Thanks!

Congrats on getting the EAD.

I had to show my card to my employer when filling out all the employment forms, but if your employer doesn't need to see the card, you will probably be okay.

FYI, my husband just got off the phone with the information line, and they said the actual card was needed before work could begin. They told him it would come in the mail between 1 week and 30 days, but after viewing the timelines, it seems like most people get it a lot quicker than that! I hope this helps!

Up to the employer - they're the ones who have to document your employment eligibility and are held responsible for following the law on documentation. I-9 says that if a person is employment authorized - and you have a piece of evidence indicating that you are now employment authorized - you have 90 days in which to show the employer your employment authorization document.

If the employer is willing to accept your evidence that you've been given employment authorization, they can start you now. If they are not willing to accept your evidence, they will not start you now. It's their decision, they are the party held accountable if their records are audited.
