In reading some of the back threads about sponcers and co/sponcers I started to get a little nervous about meeting this line.(poverty line)

I can see it(in reading some threads) not being AS big of a deal when you are having your interview during the K-1 process but more when you are doing your AOS interview..(am I correct?)

I live in the US...and I looked up the poverty line but I am looking for your information or advice just to see if I am correct in my assumptions and in what I am reading.

Boy is this experience full of ups and downs..DAILY! :(:blink:

(I know I have no time line, I promise I will have one soon.)

Just to add...thanks for this site and the people who add information.

When I get closer to filing I come up with more and more questions.

Most of them are answered by reading. But I also know how frustrating it can be to get the same questions over and over. So from me..and from my husband to be...thank you for being patient. It really does help....

Here are the figures for 2005:

Poverty guidelines 2005

If you have dependants on your tax form then these are counted as part of your household size. You must also count your fiancee. So if its just you and your fiancee then there are 2 of you and you must meet the criteria in that row.

This will increase (100% certainty) when the 2006 guidelines come out in a couple of months time.

Poverty guidelines for '06 will probably apply to anyone using 2005 tax information for either an I-134 or I-864.

Remember to multiply the relevant amount for your family size and area of the country by 1.25.

Yeah, it's more important for the AOS than the K1, but you still ahve to show financial records for the K1 visa.

03.04.2009......Posted I-130 to U.S. Embassy

03.04.2009......Ordered Police Certificate for Visa Purposes from Local Garda Office (ordered over the phone)

03.05.2009......I-130 received at Embassy

03.06.2009......Received Police Cert

03.18.2009......I-130 Approved

The 2006 Poverty Guidelines have already been published by HHS, as cited by pax.

However, the new guidelines have not become effective for immigration purposes. Not for USCIS, anyway, not sure when DoS implements them.

Many people distinguish between meeting the 125% rule for K1 and AOS - but these are only abour 6 months or so apart and I would suggest that if you don't meet it now then line up a cosponsor - just to be ready in case the K1 is denied. Good Luck

Thanks so much everyone.

I shouldn't have anything to worry about! *famous last words*

But in dealing with all the paper work it seems I worry about it all.

If with out a doubt I make those requirements then we don't need a co-sponcer correct?

Correct. If you can meet the guidelines on your own you do not need a co-sponsor. That goes for assets too. If your salary meets the guidelines without any doubts then you do not need to worry about this either.

You find a suitable Joint Sponsor and the adjustment is approved.

Or the alien leaves the USA, or the alien remains in the USA illegally.
