Hi to everyone,

I am beginning the K1 visa process and have a question I cannot find any information on. I am a UK citizen and have an 8 year old son who has Asperger's Syndrome. My fiance is american and also has Asperger's Syndrome. Will this go against us?

First of all, congratulations on beginning the steps towards the K1 visa.

Now.... why would it work against your case? :blink: I believe the only thing that would be "against you" is if its illegal drug use, criminal sexual history, or if overstayed in USA. Not based on mental or physical or social health...

I've looked at the list of visa ineligibilities and that's all fine. My son certainly isn't dangerous or anything like that, but he needs help at school, I thought that might go against us.

Asperger's Syndrome is a form of high-functioning autism for those that haven't heard of it. My son is at the mild end, his main problem is anxiety and he has difficulty with understanding receptive language.

You should be fine. I believe the only issue would be for you to prove that your son would not become a burden to the state, same thing that your fiance would have to prove for you: that he has enough income to support you both. I don't think his Aspergers is a reason for denial. Best of luck and blessings.
