AOS 134 question

Hi everyone , onother day on VJ's webpage. As you may know , my wife's I-129F got approved on May 17th and her I-130 as well (April 27th) . We will go for whichever reunites us first and in our case I think it'll be K-3 visa. My question is: On form I-134 does the Consular Officer looks at the minimum salary guideline 125% to approve that form eventhough is not a legal agreement as it is with form I-864?

And if the 125% poverty guideline is taken in consideration , what form should my cosponsor would have to fill in?

When an affidavit of support is used to help determine whether or not an applicant will become a public charge, for K visas the I-134 is used. Whilst there has been the occasional report of the I-864 being a choice, this is rare and is not suppose to be used for K visas. As for the poverty guidelines....quite often 125% is used but that also depends on the consulate as some only use 100%. I would say go by the 125% as this is what you will eventually need in order to do AOS with the I-864 once in the US. Have you had a read of the I-134 pinned thread in the Foreign Embassy Forum.
