Probably obvious questions...

I filed for lifting of conditions in May 2008, since my green card was due to expire on August 1st. Had my biometrics appointment in June... and since then, nothing. Checking online I get this:

Application Type: CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED

Current Status: This case is now pending at the office to which it was transferred.

So I have two questions... is this normal to still be waiting for this long?

And also, since my green card is now expired do I have to apply for an extension, and if so, how?

Thank you to anyone who can answer these painfully obvious questions which I'm sure have been covered here many times already...!

Normal is anywhere from 4 months to well over a year to get approved.

If you do not get the 10 year before that 1 year NOA extension letter expires (one year from the date your 2 year green card expired), you will need to make an infopass appointment and get them to stamp your passport and extend till you do receive your new GC.

However this guy's application would be sent to VSC - since he's from Florida.

So like me he's stuck at the slowest office.

Thanks for all the replies. I'm not sure what service center this is being processed in... how can I tell?

And apologies- I'm writing this from my office and don't have the paperwork in front of me... but will I get (or have I already got) an extension letter? Or is this something I need to apply for separately?

Your NOA1 IS your extension letter.

You're filing from Florida - you probably either sent your file to the Texas Service Center (TSC) given the indication that your file was transferred.

TSC is transferring all of it's I-751s to the Vermont Service Center (VSC) - so your file is at VSC.

If, by some chance, you did not get an NOA letter (the first receipt letter that extends your status for 1 year), you can make an InfoPass appointment at your local USCIS office online at http://www.uscis.gov (go to the right hand column -select "Schedule an Appointment"). Bring your unexpired passport and your expired - or soon to expire - greencard. They will look up your information via your A# and verify you filed the I-751, then stamp your passport with the I-551 stamp which extends your legal status as a PR for one year.

Your file was transferred from Texas to Vermont as Vermont is processing all applications formerly sent to Texas. It is the slowest office - 3 times slower than California- so you have a long wait ahead of you. Welcome to the club.

In answer to your questions (and no questions are too obvious to be asked or answered for here!):

-Yes, it is normal to wait this long, especially if your paperwork got transfered/sent to Vermont...

-Your NOA1 serves as your extension for another year after your conditional green card expires....

By the way, since you're also at the VSC, you can add your name and information to the following message thread list: "VSC I-751 Status List" (look for the last updated list on the last page), so you can see and track your progress too, compared to other VJers on the same long-waiting boat:

Thank you for all the great information- I have got that letter so that's a relief. Just out of interest, why has Texas transferred all their cases?

Only their I-751 cases - and it's so that they can focus on processing the backlog of other cases that they have.
