I have been away, i was on vacation because my husband arrived on April 22nd, woohoo.

I came back to work on Wednesday and i have been playing catch-up since then. JB, i am so sorry but it looks like you are already on the ball. Try to keep it in China cause if it leaves, it will be hard to appeal. I hope it works out. This is very surprising. I think that they were just looking to deny someone. It's frustrating that they hold our lives in their hands and they choose to play with it foolishly.

Philip, good luck on yoru wife's upcoming interview. Please keep us posted.

I am going to China next week to submit additional evidence in person. If I don't do this my chances of appeal are slim. By getting them to take the additional evidence it becomes part of my case file so even if we don't get the visa or another interview now USCIS may just reaffirm the case and I won't need to do an appeal. I wanted to go this week but the Chinese embassy is delaying visa requests due to swine flu. They need to make sure I haven't been anywhere where I could have been exposed. Hopefully I will return with either another interview date or knowing that my wife has been approved and will be coming to the US soon. Wish us luck.

Philip I might be in Guangzhou while you are there but it is also possible I will have left already. Keep in touch and if I am there maybe we can meet.

They asked her 4 questions:

How many time did your husband come to china? 1 time (gave letter from me explaining why I didn't come more)

How do we speak to each other? Email and talk on internet (we also send txt messages but I don't think she mentioned that)

how did we meet? We met on the internet

What work does you husband do? Works for computer company

She also gave them pictures of us together and the interviewer gave her the white slip with no explaination.

my husband visited me only once and that was it... we got married due to some chinese tradition with a parent dying.

I hope you can give us more details.

The embassy in China has been very strict in evaluating cases during the interview and have been assuming fraud even when no fraud was intended. They are supposed to be asking for additional evidence but not all of the interviewing officers follow those procedures and instead recomend denial and let USCIS accept and evaluate any additional evidence. Most of the time they won't even explain why they think you are committing fraud and just give a white slip with no explination until you receive a letter from USCIS.

Are you actually in China? Your timeline says Manilla, Philipines. These problems are specific to the embassy in Guangzhou China. Normally they can't deny you just because your husband only made one trip. However, to avoid any problems he should come with you to the interview. That will count as a second trip and you shouldn't have the same problem we did. Also bring proof of joint accounts. Shared bank account, company benefits, joint taxes, or utility bills. All these will help with any concerns they may have about your husband only being there once. Bring plenty of photos of you being together as well. The more proof you bring of your relationship the better
