If the lawyer filed the I-129 before he received the NOA1 for the I-130, then I would demand he pay you back for what you lost in the failed petition. If they filed the I-129 first or together with the I-130, then they have no idea what they are doing and have wasted your money.

Oh, I already know my lawyer's an idiot. I'm seriously thinking of getting rid of him.

But I really need to know, I'm okay to go, right, with the CR-1? Now I'm starting to get worried! :unsure:

Yep your good to go with the CR1 route and as far as the lawyer , your only going to make your process a lot slower in using one and with the looks of things considering the job that he has done so far he could cause some serious delays and/or problems. First lawyers dont use short cuts like we do, they wait for the snail mail. On top of that you are 1 in a possible 100 client base, so even after they get the mail they get to your case when the can/will. Congrats on your I-130 being approved and if you feel comfortable without your lawyer (which unless you have some problems that you think will hurt your case you should be ok) this website has all the answers you could need and the people on here will have no problem saying "I would get a lawyer and now" if there was a situation that needs one.

Congrats. The cr1/ir1 can also be fast at NVC if you gather the documents ahead of time. You should also use LOTO's guide. Good luck.

2006: Engaged

10.2006: Contacted lawyer to begin paperwork

4.30.07: Legally Married in Ft. Myers, FL

8.25.07: Religious Ceremony in St. John's, NL

12.6.07: Paperwork filed to USCIS (after trouble w/lawyer)

1.18.08: I-129F NOA1

2.29.08: I-129F Touch

3.13.08: I-130 NOA1

3.19.08: I-130 Touch

6.30.08: I-130 Touch!

7.1.08: I-130 Touch again!

9.3.08: I-130 NOA2!!!! (And weirdly, I-129F denial. Guess I'm going CR-1 route!)

6.23.09: Package... 3? 4? I don't know, but Andrew had his interview date scheduled.

Cheers - you got the one that counts - it may mean a few months more but then you are done with uscis and dont have to do that horrific interview in the states-

If your lawyer filed both together meaning the I129F and the I130 that is accepted or had been up to December of last year - if he did not then yes there is an error but someone was looking out for you in getting the I130 instead.

Do you think it will take longer to get the K1 visa than it would have taken to get the K3, if you had been approved? If so, I'd be really pissed at my lawyer.

Cheers- Actually its not that much more and there are so many pluses to the CR (I130) vs the I129f that once you weight the two together, the scales balance out - I have heard pretty ugly stories about the I129f fees of course, and the waiting time alllllllllllllllllllll over again to get status - but i guess that depends if one month or two matters and with paying fees online now with NVC its not even that.
