So, after a BAJILLION months of waiting, Andrew's petition for immigration was APPROVED! (I-130)

...And, oddly, denied (I-129F).

See, when I filed K3, both the I-129F and the I-130 at the same time. For some reason, USCIS sent back the I-130 to my lawyer who had to resubmit. So, even though both should have been filed at the same time, the I-129F was filed first.

Anyway, long story short, I get two letters today, one stating the I-130 was APPROVED!!!! (As of 9/3/08, but for some reason it still says it's "pending" online.) And another saying that the I-129F was declined "Because the Form I-129F that you submitted is based upon the Form I-130 that you filed subsequently."

So, I assume this means I'm going CR-1 route, I assume?

There's no negatives to the I-129F being declined as long as the I-130 is approved, right?

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

If the lawyer filed the I-129 before he received the NOA1 for the I-130, then I would demand he pay you back for what you lost in the failed petition. If they filed the I-129 first or together with the I-130, then they have no idea what they are doing and have wasted your money.

NOA1's for AOS/EAD received Sept 20 MSC #

Biometrics completed Nov 5 2004

EAD Approval Dec 29 2004

AOS appointment letter received Feb 3 2005

AOS interview scheduled for March 9 2005

AOS interview mostly fine, just need I-693 supplement filled out by civil surgeon

Spend another $40 for I-693 form, sent to local USCIS office registered mail, arrived March 11 2005

AOS finally approved March 25th 2005

Green card arrives about 10 days later

!!Green card has incorrect middle name!! Thanks USCIS

Travel back to Denver, turn in card and I-90 to correct their mistake.

Application accepted, asked for I-551 stamp, they told me "We don't do stamps anymore"

NOA1 for I-90 received from NSC April 18 2005, fee waived

NSC appears to have stoped processing I-90's

Marilyn needs to travel back to the RP, call Senators office for help with green card or I-551 stamp

Travel back to Denver July 1, 2005 and received I-551 stamp in the passport.

Many congrats!!! The I129-F denial may well just be someone else looking out for you. The cost, stress and paperwork (particularly the latter) of AOS frightens me. The CR-1 I'd recommend to everyone except those with very special circumstances. Oh well, the grass is always greener on the other side of the fence. :)

Oh, I already know my lawyer's an idiot. I'm seriously thinking of getting rid of him.

But I really need to know, I'm okay to go, right, with the CR-1? Now I'm starting to get worried! :unsure:

I'd tell him that you're considering a malpractice suit if he doesn't refund your money.

Seriously...anybody who can read the application knows you don't file an I-129f petition BEFORE an I-130...not unless you're petitioning for a K-1 Fiance Visa.

As for are you "good to go", yes, Yes, and YES.

Doesn't make a difference why they denied your I-129f...they should administratively deny/cancel most I-129f petitions when an I-130 has been approved.

I-129f is absolutely an inferior path to the I-130, with the exception of certain extenuating circumstances.

However, note (although it's not an option for you) there can be potential advantages to keeping an I-129f (K-3 Path) going, whereas one might be able to get

an K-3 interview date sooner, and then swap it for CR-1 interview (it's complicated).

Bottom line, don't put any more money in your lawyer's pockets. If you really don't have the time to do the rest of the process yourself, hire a competent lawyer...otherwise, just read the forums here, and ask questions for guidance. Unless you've got some serious issues, it's not that difficult.

no harm done..I-129 is disapproved, who cares....atleast the big I-130 is approved and u r on ur way to getting a CR-1 visa.
