Hi everybody,

I think this is my 3rd post here, I've been reading and checking this wonderful site a lot lately whenever I have free time I just come here and read the posts and the guides, all you being a wonderful help and support to others who really need it :) like a one close community sharing the same issues and really understand each other's feelings, God bless you all.

The thing is sometimes the more I read on this site the more I get confused, am living and working in UAE (United Arab Emirates) my fiancée is coming to meet me for the 1st time staying like for two weeks, we've been known each other almost 5 years now on the internet beside phone, if things went fine and hopefully will between us I just want to know couple things or I think my mind will blow,

if we go thru the K1 route and start the procedures when she go back to the US, will the petition will be on hold when it reached to the service center which I believe Nebraska since the new IMBRA regulations?? And if it wont be on hold and saying things went fine to the point of consulate interview here in UAE. There some kind of large age difference between us (shes being much older) will that be a red flag and big no for the officer so they might deny the visa??? Cuz if we got a denial which will be a disaster for us , it means if we want to apply for another K1 we need to wait 2 years since the new IMBRA rules, that means long time separation and waiting which is hard to bear, we've already waited long on the internet.

One last thing, for the above reason might happen, if we decide to get marry during this meeting, is applying for K3 instead of K1 will waive the possibly red flag from age difference since we are married?? even thu I've read on this site also that marrying in a short period will sometimes rise a red flag on some situations.

Please advice

Thanks very much (L)

We are going K1 and also have an age difference much the same as your situation. It is not uncommon. Yes, I suppose it could be considered a "red flag" and will be looked at. However it isn't something you can't overcome. Work hard to make your case strong with lots of proof to support it. The more time you can physically spend together the better.

I am much older then my fiance but we made it all the way through his interview and are now waiting out his processing. They did question him in the interview about the age difference, of course. I lived in Egypt with him almost a year before we filed K1. We would have gone K3 but things just didn't line up for us to do that route.

I wish you all the best and this is a wonderful place for support and information.

Welcome!!! you are in the right place and I am sure that you will get a lot of great advice throughout your journey...there are few things that you may want to consider when chosing which way you will proceed...Age difference is considered a "red flag" but it has been proven thru many approvals that there is more to each case than an age difference...I did a K1 process and had few of the so called "red flags" but got approved and processed within 4.5 months...so as you can see each case is different...there are advantages and disadvantages to either process and just take a close look at what would work best for you both...Wishing you a wonderful time with your fiance and best of luck...keep us posted as to how things develop...

Dorothy

thanx so much everybody.

I think we need to count all the advantages and disadvantages of each route and decide which one is the best for us.

Well you better focus and not let your mind blow. The fact that there is an age difference between you and your beloved one is not a big deal if you have enough suppoting evidence that would verify your relation. I think that applying for a K3 visa usually takes a much longer time to be processed than K1. Yet putting in mind the new regulations one should careful but I cannot see that there is the slightest probability of your K1 case be denied due to age difference, how old are you if your over 25 years old it will not be an issue. The usually red flag cases when one is 18 the other 50 this will arouse doubts about scam...etc

I hate to burst the bubble but there are many many K1's that have been denied and there was no reason given by the CO. The petitions were returned to USCIS seeking revocations "due to the validity of the relationship" ( Most couples found out the reason from their senators or congressman). Turns out most of the women (US citizen) were older than the men.

Age certainly a factor (red flag). It doesn't have to be a 30 year difference either!!!

However, there are also quite a few K3's that have been denied as well due to the age difference. Same set of events...petition returned to USCIS recommending revocation "due to the validity of the relationship".

Just an FYI. As a matter of fact there is now a separate group for these couples to interact and support each other on yahoo.

In our case, my husband had a folder filled with so much proof of our relationship, but the CO didn't look at it. He plain out lied to him saying "he needed more information from America". What he did was return our petition saying that my husband failed to prove we have a valid relationship!!! I took so much time and effort to cover everything and this is what happened. Needless to say, be sure you find all the red flags in your case. You can have all the evidence bit if the CO refuses to look at it, it won't matter. You will have to shove it down his throat!

There has been a study done by our government on older women marrying younger men especially from middle eastern countries. It seems the marriages fail so the recommendation was made for the consulates to return those petitions back to USCIS further review. This info comes from an established immigration attorney and my senator and congressman.

First of all, you are working and residing in the Emirates right? I am assuming you are not from the emirates, so you might want to check to see if you can even marry there. Secondly how fast would you like to be together? I am assuming quickly so you might want to find out the wait times for UAE or your own home country's embassy.

Do you know if that study is public? I'm sure many people who are beginning their process here would be interested in more details.

I don't know that either, I was told that when our case was returned to USCIS. I will try to find out. I do know that peace Corps has an article about relationships between older women and younger men. i can send the link for that if you are interested.

Well, I'm not really personally interested, but I know people come around to the ME/NA forum often looking for more information about that particular potential "red flag" in their case. It might be useful to them to know exactly what they're up against in terms of USCIS's view of older woman/younger man relationships. I'll see as well what I can dig up about this "study" done by USCIS.

Thanks, chiquita!

Ours was a K3 visa because we are married. We have been married 2 years and are awaiting a 2nd interview in Casa since having our case reaffirmed by USCIS.

Best advice...get your evidence and make sure you show it even if they dont ask or say its not needed. fight your way to get that visa!
