Timeline

Hello all. I already have my SSN, and I went to the DMV to get a CA state ID. They said I could not because my I-94 would expire in 87 days and they need 90 days to process. Is this true or did I get an uninformed employee? I was really hoping to start driving soon too :wacko:

they are probaly right. that info should be on the states dmv website. here in tx you have to have 6 months of valid i94 or EAD.

Timeline

Many states will not allow someone who came into the US on a K-1 visa to get a state ID or driver's license until you either have your EAD card in hand (and even then the DL would only be valid as long as the EAD card was valid) or you have your green card in hand.

Because you went in with only your I-94, they are basing your status as a state resident on the length of the I-94. Methinks you are going to have to wait until you get your EAD in hand and try again.

just got this off the cali dmv site,looks like you will have to wait for EAD

Only the original or a certified copy of one of the following documents is acceptable:

US Birth Certificate

US Certificate or Report of Birth Abroad

Federal Proof of Indian Blood Degree

INS American Indian Card

Birth Certificate or passport issued from a US Territory

US Passport

US Military Identification Cards (Active or reserve duty, dependent, retired member, discharged from service, medical/religious personnel)

Common Access Card (only if designated as Active military or Active Reserve or Active Selected Reserve)

Certificate of Naturalization or Citizenship

Northern Mariana Card

INS US Citizen ID Card

Permanent Resident Card

Temporary Resident Identification Card

Canadian Passport/Birth Certificate

If your BD/LP document has an expiration date of less than 60 days, you may complete your licensing requirements (written/vision/driving tests), but you will need to submit another BD/LP document with an expiration date of 60 days or more before your driver license or identification card is mailed to you.

Before your limited term driver license expires, the department will mail out an “extension” letter with instructions on how to complete your application for a driver license.

I think DMV employee was wrong cus look at what I highlighted. You sure fall into this category. Plus you couldn`t come 90 days prior your I-94 expires cus thats how much time immigration officer was suppose to give you at POE.

Try again, if you will experience any troubles take the list of required documents and point the topic I highlighted out to them or ask to spak with a supervisor.

So she has 87 days of validity remaining which according to ypur post is enough, 87>60. They told her they need 90 days of validity not 60, but in reality it is 60.
