Can the congressman help us?

I have a follow-up question... When reading the thread posted here containing questions/recommendations from the former adjudicator (I believe his name was HuskerKiev?) he mentioned that Congressional intervention could speed up the process, but it seems like that is no longer the case... What changed?

We didn't hire a lawyer expecting that the lawyer would make anything faster for us. We simply decided to make that investment. We have never dealt with immigration papers before and we decided that investing on a professional who has done this procedure many times before was safer that saving the money and risk making mistakes that would delay the process even more. And although lawyer make mistakes also, it was certantly a safr bet.I completly understand the fustration on everyone's part regarding being away from their loved one. My fiance and I lived 30 minutes from each other for 5 years, saw each other on a daily basis, spoke several times a day, were closo to each other's family and friends. Now we are in different continents, and although we still see each other everyday now it is through a screen and it certantly does not feel the same. We knew what we were getting into when we filed for the visa, we know we got a while more of this horrible waiting, but mean while we will ask, research and do whatever it is that we can. Sitting around and waiting simply isnt an option for us. Maybe all our tries will be useless, and the question wnt lead to nothing, but we will exaust every option available to us. After all trying never hurt anyone. Thank you for all the support! And good luck to everyone.

I'm not quite sure what you mean by "waiting around simply isn't an option for us". I don't want to discourage you from trying anything, but at the same time, think realistically. How many thousands upon thousands of people do you think have had the same thoughts and ideas as you? I for one, had them as well. I thought "there has to be a way to speed things up and make our case get processed faster", but soon learned there isn't, save for expediting the process.

I even have family friends in the immigration unit department in the US embassy in BKK and they couldn't do anything to help speed the process along once it got to the US embassy in Bangkok.

Good luck on your attempt to speed up the process. While I doubt you will be able to, I'm pulling for you.

This is if your case is taking longer than the processing dates suggest it should. For example, if the current processing time frame is like... four months, and your case hasn't been processed after 6 months and you can't get any information on why it's taking so long or what's going on, then you can get your local congressman involved.

This option isn't for people who are still well under the current processing timeframe and just want to speed their process up.

For example, if the current processing time frame is like... four months, and your case hasn't been processed after 6 months and you can't get any information on why it's taking so long or what's going on, then you can get your local congressman involved.

That information is five years old, or however long. Although people are free to read any or all of it, I personally wish that there were a big flag on the information to state how old it is. The excited or desperate tend to view it literally or as current gospel.

What has changed? Congressional offices apparently have a special line (person) to call with inquiries, but it is for information only (response within 72 hours, if I recall what I was told). No special attention or treatment is given to cases beyond a 72-hour response about "status" to the congressional office.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

When I said just waiting around isnt an option for us, I wasn't just refering to trying to speed things up. (although we are :)) By not "just waiting around", I meant that we are preparing ourselfs for what is ahead of us, collecting as much proof as we can of our relationship, preparing for what may be asked of us at the interview, researching our options if God forbit our case is denied. Talking to as many people as we can that have been through this. Some people choose to just lay back and wait. We are choosing to be pro active. Im not saying we are doing the right thing and everyone else is wrong, we are simply doing what feels right to us. Each case is different, everyone is different. Maybe this will pay off in the end, maybe it won't. Regardless the time and work we are putting towards our case will never be "wasted", if anything it's bringing us even closer together as a couple. I hope I cleared things up. I never intented to imply that we deserve "special" treatment. We are in the same boat as everyone else, and just like everyone else, we just want to be together as soon as possible.

I contacted my local U.S. Representative's office twice when we needed specifics to our case that USCIS wouldn't answer. They had a form for me to fill out just for this purpose so I'm sure your local office has had your request before. I don't know if they technically have legal power to "speed" anything up, but both times we did it, we got our problems solved within days. Coincidence? Maybe, but if I got an inquiry from a Congressman, that would light a fire under my butt to get an application through.

I contacted my local U.S. Representative's office twice when we needed specifics to our case that USCIS wouldn't answer. You'll also find that help from congressional inquiries varies from state to state and who is contacted, congressman or senator. Over at immigrate2us, which primarily deals with waiver issues, many people have had no help at all from their US senators. I some states, the congressman's office will forward the case to the senators office. Or if you have contacted the senator with no results, the congressman will follow up with an inquiry to the senator's office. There doesn't seem to be a tried and true method that works consistently. And as previously stated here, all they can do is inquire about the status of the case. However, there have been times when an inquiry has lead to results rather quickly. Who knows?

Personally I was disappointed with the contact I had with my senator's office in regards to my waiver case. Busy office, perhaps no followup? They were months behind on their inquiries. They recieved my letter in early August and the inquiry wasn't made until the middel of October. Many follow up phone calls were made by me and I was told they hadn't heard back from the consulate yet. This was months after the inquiry was supposedly made. I was told each time I called that they would contact me as soon as they heard something. I was told that they would investigate and call me back the next day. No one called, so I would call again. All in all, I was disappointed. My fiance is here and we are married and have filed for AOS. I still haven't heard from my sentaor. Did his office have anything to do with helping? Who knows.

For us, calling congressmen did not speed up the process at all even after we became out of the normal processing time.

All they can do is to make an inquiry and USCIS officers will tell them the same thing that they tell you.

Even after you become out of status, they will tell you to wait another 30days....

For us, it took about eight and half months just to pass CSC.... (They lost some of our docs and RFEed us after 7 months....Mmmm)

So....I am sorry to tell you this, but there is not much you can do with regard to speeding up the process.

The best thing is to enjoy your time with your family and friends back in your home country.

After it reaches NVC, everything goes really really quickly.

Waiting for I-129F approval is the hardest part of this immigration process.

Once you are done with this waiting game, everthing, including AOS, seems a lot easier.

I hope your application gets processed quickly and your reunion day comes very soon.

our congressman will do nothing nada but our senator did and got the same same information that they give us all they do is an inquiry ur right about that.......sometimes it makes them pay attention but in the year that we been dealing with this mess of k1 i have found that csc just seems to work in their own little world and there really does not seem to be much anyone can do to speed them up or to make them abide by their time line that they them selfs give....what i have found is dont expect much and be surprised :whistle: we still waiting for our surprise lol

just take it easy and enjoy ur time with ur family as some one else said......stay busy and pray is all that is in our control and hands everything else is in the hands of the government

That was posted within the last year, year and a half. He clearly states when he worked there. Getting your congressional official involved is dependent upon your congressional official. Some help, some don't. Really, they shouldn't do anything until after a person is outside of processing times except in exceptional circumstances. There's a line with thousands in it, everyone needs to wait. Definitely look forward to what comes after you get the NOA2 and have everything ready to send off to speed stuff up. Some embassies are helpful about working with you and some aren't. The UK embassy (at least last year) was very accomidating to several of our members, including us. We put in our wedding date and got a fairly early interview. Another member called and got her appt moved up.

no I am afraid not. Believe me I have treid. They will respond to you but their response will be unless it is out of immigration timelines there is nothing they can do. Sorry
