You need to go check out www.immigrate2us.net . . .there are a ton of people who can answer this question. The backlog seems to be taking around 10 months, but you really need to look at some of the samples there and make sure you have a strong evidence and letter package. If you don't feel confident in your evidence there is time to send supplements.

Backlog for what????

The waiver was denied....period.

He has to wait like 5 years from the day he left the US.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Mexico is DIFFERENT. Please be careful with this type of information. She is correct. Mexico is under a special pilot program wherein they are allowed to make a "waiver appointment." Any waiver that is clearly approveable is adjudicated same day and the visa is issued within a few days.

If the waiver is missing proof, the person needs AP, there are criminal convictions, or any complications at all the waiver is sent to what is called the "backlog" where it is adjudicated after processing is complete or in order of receipt.

Plus, where the heck did that 5 years come from? No such waiting period. . . . .

 c

my husband had his waiver appointment in ciudad juarez.... on 06/18/08

the waiver was found lack of hardship..... what is the waiting period?

The waiver was backlogged due to lack of hardship? If this is the case, you need to strengthen your waiver package. Please provide more details.

A consultation with a good lawyer is a good place to start. Heather Poole at http://www.humanrightsattorney.com/ or Laurel Scott at visacentral.net is a good place to start. The best site for waivers is immigrate2us.net. Many hours of reading there will help you. There are examples of hardship letters etc. They have a forum for Mexico. Mexico is very lenient for waivers with an approval rate of about 80%.

You need to submit a better hardship package to help your chance for success. Is the only reason you were backlogged because of lack of hardship? Did your husband have any criminal history, DUI, drug use etc? What was the reason he needed the waiver, illegal entry? Please provide more details a and check out the other site.

If you were put on backlog due to lack of hardship, please do some research and strengthen your hardship package. Consider using one of the recommended lawyers. Spend many hours reading at immigrate2us.net. It takes a lot of work to get a waiver approved. Leave no stone unturned.
