RebeccaJo i don't doubt is very knowledgeable and could have helped me, but instead chose to berate me because i am not going about things the way she likes. Which i feel is :ot: !! And has pretty much hi-jacked my nice little thread lol.

05/29/2008 --- Entry into the US on Visa Waiver to visit my girlfriend for a summer holiday and to help take care of her sick father where needed.

06/20/2008 -- After the sad passing of my girlfriend's father, we decided to get married and stay together

08/08/2008 --- We get married, lovely ceremony and dinner with all of Sarah's family present :-)

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

09/02/2008 -- Checks cashed!!

09/03/2008 -- NOA1 received for I-485, I-130 and I-765.

09/05/2008 -- Case is shown online as pending!!

09/08/2008 -- Biometrics appointment letter received for September 23rd!! (For both I-485 and I-765)

09/12/2008 -- Biometrics walk-in completed, 11 days before the appointment! In Hackensack NJ.

09/20/2008 -- RFE for I-485 received. It was dated September 17.

09/25/2008 -- RFE response evidence sent out to Lee's Summit by USPS, certified mail.

10/02/2008 -- RFE response evidence received and case processing resumed!

11/04/2008 -- EAD CARD PRODUCTION ORDERED! Thank you Lord.

11/10/2008 -- EAD card received in the mail! wOOt wOOt!!!!

11/12/2008 -- SSN ordered from Hackensack, 2-4 weeks in mail!

11/28/2008 -- SSN Received in the mail, wOOt!!!!!!!!

12/7/2008 -- INTERVIEW LETTER RECEIVED!!! It's scheduled February 19, 2009 at 8:30am in Newark. *nerves*

2/19/2009 -- Interview 8:30am - Green Card verbally approved

2/23/2009 -- Welcome letter received! followed by I-130 approval notice!

I've not bashed you. I've apparently made you uncomfortable though. As someone else pointed out, if you are having trouble answering my questions, you'd probably have a lot more trouble at your interview. So in that sense, I do believe you have been helped.

My note about my timeline is nasty on purpose. I know you don't want to research my posts and I don't really blame you - we all have lives. I always regarded my timeline to be one of things in my life which went really well and I have always been grateful for it. It's one of the reasons I stayed around here to help others. I wanted to do whatever I could to help them shorten theirs as well. But over the course of years, no matter how nicely I would write, it was attacked. Things got particularly bad around here this last year when others were suffering very long timelines. I could hardly enter a thread without being told to get out. Actually, I rarely participate here any longer because of that very fact.

If you wish to learn more about adjusting from within the US without benefit of a visa, I'd suggest you google the phrase "Ten Foot Pole". It will probably lead you to britishexpats.com and the writings of a lawyer named Folinsky. This research would very much help expand your understanding of the law.

You might be surprised to learn that I've always been a staunch defender of a persons right to adjust from within. My admonitions to you are NOT based upon the same thinking as some of the other nasty stuff I've seen posted to some of you. Most folks (and yes I'm categorizing) get PO'd because you didn't file, wait and suffer like they perceive themselves to be doing. So I'd like to make it crystal clear that's not where I'm coming from.

Flat out bottom line - immigration law is complex and there's loads of opportunities within the code for the government to get what they want. If they decide they want someone out - make an example of them - they can likely do it. Our political climate in the US is at present, IMO, not immigrant friendly and our Senate will likely within the next president's term write more legislation which will seed from that political climate. I've played my husband's immigration completely close to my vest and as nearly in accordance with present law because of that. When people ARE considering short-circuiting the VWP, they are usually smart enough to research first. Perhaps they'll find discussions like ours in their research, and it will help them come to a safe conclusion.

This is getting silly...and like you, bluegreen, I have bitten my tongue and promised myself I wouldn't participate in this thread anymore on more than one occasion :P

To me, there has been more than one instance here of misinterpretation of the 'intent' behind advice to be careful to collect relevant evidence should it be asked for, particularly if the advice comes from someone who went the 'traditional' K1 route. I am starting to think that this is projection of some sort because at no point in the thread has anyone said that adjusting from the VWP is wrong if there is no intent to immigrate.

I am not a supporter or personal friend of Rebecca's. I agree that sometimes her posts come across as haughty and condescending and that in this instance she has responded to the OP in a way which suggests there is some history there. Any of us can use the search function (and I have) to understand which direction people are coming from and what other interaction or 'argument', for the lack of a better word, there may have been between them and another member of the forum. This 'history' has clearly formed the basis for Rebecca's comments on abuse of the VWP. If she wants to berate Richard for previous posts on the forum then I am not really supportive of that because he has clearly experienced some unfortunate and distressing changes in his and his wife's situation since March. However, amongst all of this she has given good solid advice to him about how to go about ensuring he can stay here with his wife. And nothing she has said about the VWP is incorrect or untrue.

Despite Richard believing that Rebecca has trashed his thread, this thread is not his. He asked a question on a public forum and received many valid responses to that question. When I was researching this process I rarely posted a new thread unless I was unable to find one that met my needs (and I'm not saying no one should but it's important to draw a distinction here about ownership of a thread). If I were researching how I could be with my boyfriend/fiance I would probably have come across this thread via means of search terms if not the title or placement in the AOS forum. If someone said 'yeah, it's dead easy! Intent isn't important to USCIS. They don't care about that!', I would be buying my air ticket, giving up my job, my home etc. in a heartbeat. Really I would.

I would speculate that 90% of the K1 population have thought about adjusting on the VWP. The times I visited and didn't want to go home, when J begged me to stay and I considered staying because it hurt so much but took the 'sensible' route because I was scared. Because I really didn't have the balls to do it once I had read the ins and outs of it, thanks to Kezzie (successful VWP adjuster), diaddie, kitkat1, pushbrk, Rebecca and many others I have failed to mention - all those straight talkers, who generally care more about the truth than whether the community liked what they were telling them or not. I dare not speculate on how many VWP-adjusters considered K1 because I would clearly get lynched and accused of being 'bitter'. Obviously, it is easier for me to admit to intent to immigrate.

Here is a good example of a thread which did not degenerate into accusations that K1ers are just bitter about VWP adjustment - because that is precisely what some of you are suggesting here.

Is it wrong to point out the purposes of the visa-waiver program? Maybe that discussion would be better placed in a VWP general discussion thread - I would agree with bluegreen there.

But, in the context of this question, is it wrong to point out the facts about adjustment from VWP? Is it wrong to point out that the I-94w states quite clearly that you waive your right to appeal any adverse decision on your adjustment of status? Is it wrong to point out that you *could* be deported? Would it be wrong to also point out that even if a VWP-adjuster receives an AP document they *may* have a problem returning to the US after a visit back home prior to a successful AOS adjudication? Is it so wrong to point out these possibilities because it may give someone sleepless nights? Is it wrong to say 'hey if you had no intent to immigrate you have NOTHING to worry about, but you may still have to prove that you didn't'?

Equally, I don't feel it's wrong to ease peoples minds on adjustment in these case. Using anecdotal evidence is always useful but it is wrong to jump into a thread and leave an ill-thought out comment and suggest that there is absolutely NOTHING to worry about and don't even bother covering that particular piece of ground because anecdotal evidence suggests that it's UNIMPORTANT to USCIS. If it were so unimportant and simple, then everyone would use the VWP to meet their immigration needs. Seriously! Let it be known that if it really were that easy I wouldn't have bothered with K1. I could have saved a heap of cash and worry.

Frankly, I don't care whether you have a K1 or not - what I do care about is that people are informed enough to make the right choices for their situation and that if that situation changes then they receive appropriate advice to get the best possible outcome. It really bugs me when people routinely tell people they should go home and file for K3 in these situations. However, it is really important for everyone to know what *might* happen.

I had many a sleepless night over my K1 application, medical and interview. I spent 3 days putting together a 3 inch thick file of evidence for my interview. None of it was asked for. Does that annoy me? No. I'm glad I covered all my bases. Will I have sleepless nights if I get called in for an AOS interview? Probably.

Neither am I suggesting that choosing the K1 route gives me superiority over VWP-adjusters, because, as some have suggested here, I had to wait longer blah blah *yawn*. It's irrelevant. Really, it's irrelevant. What irked me is that people were giving the impression that VWP adjustment is as easy, if not easier, than the K1 process. That's not good advice because with K1 the risks after entering the US on the visa are much less. There's still a possibility of AOS denial but, the important difference is, you have the right to remain in the country for the purposes of appealing that decision.

We're all in love, we all want to remain in the US without any hassle. I don't understand why warning someone of the possible pitfalls is being negative and judgmental. Maybe there's some projection going on here - possibly due to those statistics I speculated about.

The important thing is that Richard and others in his situation are informed enough to ensure a successful AOS, to know what the rules are . Anecdotal evidence suggests that it will be fine. I genuinely hope it is.

good luck Hydey I hope things turn out well for you.. life does happen, when you are apart and you are both falling apart emotionally, and it starts to affect your health because youre waiting for a process I wouldnt judge anyone for seeking alternative routes..
