If a person knows they intend to live here, with an American they already have a valid relationship with, why NOT file the K1? Why NOT do what the US government has asked all intending immigrants to do, rather than abuse a privilege put in place originally intended for business and pleasure travel?

To me it's that simple.

I agree. It is that simple. For all but the first of my trips to visit J on the VWP I knew that I intended to live in the US.

You have come to this community many times asking questions. When you ask questions, as an adult you can expect to get answers. They aren't always what you want to hear. But they have value nonetheless.

I get the impression you are mocking me when you call me 'dear'. Let my post history stand as a record as to whether or not I know what I am talking about when I answer questions. Let my post history also stand as a record as to whether or not I have previously predicted the government would take away services offered to immigrants once it became apparent a service was being abused.

I've lived 50 plus years on this earth and I'm far far more aware than you that situations arise in life which change our plans. While I was learning those lessons, I discovered that I often wasn't as clever as I thought I was when I tried to smart-a$$ my way around a system.

You have chosen (perhaps by life circumstance, or perhaps by the convenient timing of one) to take a path which involves some element of risk. Having done such, you should be more willing than others to receive ALL information available to you. Whether it suits what you want to hear or not.

Ok, I personally don't think any of us have the right to point fingers at someone else for his/her situation. So if someone (there are ALOT, specially Brits) who come to the US get married (using the WVP priviledge given to all 27 countries under the WVP) they are crooks? dishonest??

I think you're judging to harshly. Everyone in love (REAL) get married and each person has a different story.

I'll remind EVERYONE the large amount of Asian and South American "true" marriages just to obtain the GC. A large number of K-1 marriages are frauds, but they do this to avoid eyes from the US government. Where as its easier to stop a lier in any Adjusting Visa Status and WVP passports.

So some of US really have to start focusing on helping instead of attacking.

Personally I didn't think any judging was taking place. We were discussing proving or disproving 'intent'. Some said this wasn't really important as it was hardly ever asked for at interview. At no point did I state that adjusting on the VWP was incorrect, provided there was no intent at the POE - and frankly a LOT of K1/K3 applicants investigate this avenue.

The point here is: You may not have to provide evidence regarding intent, but then again you MAY have to. It is best to be prepared for that, because it states on the I-94w that you waive your right to appeal any decision.

There may well have ensued a tangential discussion based on previous posts by the OP on other threads but it is important to point out to others who are seeking advice on adjusting from VWP that this evidence MAY be required of them.

That's exactly what I ask myself when I see your way to "help" others, it is not relevant nor helpful on anybody's case if you are going to reprimand them instead of guiding them. Treat them as adults and just INFORM them, don't lecture them like 5 year olds.
