AOS March Filer - Background Check Taking a Long Time

We filed my wife's AOS on 3/10/08, our case got transferred to California on 3/31/08 and we got a Medical RFE on 5/21/08 (they lost K1 Medical and we went ahead got another medical and they received it on 6/11/08).

We called a few times to ask the status of the application and they said it still in background check processing and there's nothing they can do.

Has anyone experiencing this type of problem?

How long can they keep the application pending before they have to approve it?

Do we have to wait indefinitely till they get something back? What happenned if they lost the background check file like they did the Medical?

Some have taken 3 years.... There are reportedly new procedures that if the background check takes longer than 6 mos., then they are to try to tentatively approve the application subject to the proper results returned from the FBI.
