I-129F filing after I-130 approval...does it even make sense?

Timeline

I have filed an I-130 in October of 2007 and it has finally got approved. :thumbs: Since the I-130 took so long and I never received the NOA1 for it, I decided to consult a lawyer who suggested that we refile the I-130 and do a K3 as a dual effort. (please check my timeline it might help understanding this)

Nevertheless the second I-130 got filed in June.

I have since received an approval letter for my inital I-130 that I filed last october without a lawyer. I am being an optimist and are thinking that her interview process at the Warsaw Embassy will probably happen in about 110 days. Perhaps Im not correct in this assumption?

Needless to say my lawyer thinks that I should file for the K3 anyway (I would have to pay him for this). I checked this site and the current avg # of days for K3 is 159 (i think I looked at it correctly). Considering those figures to me it doesnt make sense to file for the K3, but my lawyer insists that its a good idea just in case it does get aproved quicker.

Anyway, I am thinking that it is a complete waste of money at this time to apply for the K3. :huh:

Can you guys please comment. Im right or wrong? :help:

I believe your I-129F will be ignored due to the fact that the I-130 is complete... It will be a waste of effort...

PS I think it is time to get another lawyer............

You're lawyer is incompetent at anything but collecting fees. Fire him and stick with the I-130/immigrant visa process already in motion.

Facts are cheap...knowing how to use them is precious...

I agree with what everyone else has said here. Why pay more fees to your lawyer, pay over a thousand more dollars to adjust status; when chances are they will ignore your 129f?

I would tell my lawyer thanks but no thanks.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks for everyones responses :thumbs: . I have informed my attorney, and to his surprise, that I do not wish to file the I-129F at this time. He tried to convince me that this is the right way to go for a couple of days, but finally gave up. I guess those guys really care about one thing and one thing only. The $$$$$ signs!
