On I-864 instructions part 6 no. 25 page 8 :P It says "You must provide EITHER an IRS Transcripts or a photocopy from your own records of Federal Income Tax Return for the most recent tax year" Its up to you what you want your husband's ITR to provide. GOodluck and blessings ^_^

I just found out that my husband's dad claimed him as a depedent for 2005 and 2006. Can I use that as my explaination why he didn't file taxes for those two years?

Im not sure about that..but if that's the explanation why he didn't file taxes then that's what you wrote in your explanation. Im sure someone in here who knew about this more will comment on this question of yours :star:

Im not sure about that..but if that's the explanation why he didn't file taxes then that's what you wrote in your explanation. Im sure someone in here who knew about this more will comment on this question of yours :star:

Did your husband have "taxable" income from 2005 and 2006? If he did (above a certain minimum - $5,350 in 2007 - probably a little less than that in 2005/2006), he should have filed a tax return. Both of my daughters (ages 18 and 20) have been filing tax returns since they were 16 (they both began working part-time at that age). I still claim them as dependents, but they have reportable income and had taxes withheld. Their income is low (less than $4,000 per year) so they end up getting a return for all the federal tax withheld.

Check IRS publication 501:

If your husband made less than the minimum amount in either tax year, then that would be the reason for not filing (not that he was claimed as a dependent by his father).

If his income was above the minimum, he was legally required to file.

If his income was below the minimum, but he had federal taxes withheld from his pay, he should have filed (and received the return).

So, a few questions are:

1) Did he work in 2005 and 2006?

2) Did he receive W2's from his employer(s)?

3) Did he make above the minimum for each year?

4) Did he have federal income tax withheld (box 2 on the W-2 form)?

Thank you for the explanation. So my husband did not work in 2005 so we dont have to worry about that year.

In 2006, he only worked for three months. Though his income was low, I am pretty sure that he had taxes witheld from his paycheck. I dont think that he did file for that year since he joined the navy right about the time we file taxes.

Anyway,

So if he somehow did not get W-2 and is not required to file taxes, all we have to do is just write an explanation that he didn't make enough income, correct?

BUT If he somehow supposed to file taxes for 2006, but he didn't, what is our option now? What do we have to do to get that taken care of?

By the way, my husband is on the deployment that is why it is so hard trying to get hold of him.

Another thing that I have is that since my husband is on deployment, can I be the one who call IRS and ask for his tax transcript for 2007??

If he had low income, but had taxes withheld, he may still be able to file. He would most likely get money back. It's not too late to file 2006 (he has until April 15th 2010). He would have to contact his employer and get a replacement w-2 if he doesn't have one. Consider contacting the local Taxpayer Assistance Center recommended on the IRS website.

With regard to the transcripts, the form 4506-T requires the taxpayer's signature. You might also ask the Taxpayer Assistance Center about how to get your husband's transcripts while he is deployed. Otherwise he could call them and request the transcript.

When were you married? If you were married in 2007, he should have filed with you and not as a dependent on his parent's return.
