Hi guys,

I am filling out I-864 form and I just so stuck on Section 25..so I just hope that somebody will be able to help me :)

So my husband (the petitioner) joined the navy in 2007 so we only have tax information from 2007. Well, he actually worked part time for about 3-4 months at a restaurant in 2006 (From Aug 2006 - Dec 2006) but he didnt filed taxes at that time..it might be because he didnt make enough income that require to file taxes.

Anyway, for the box that it said, "I have filed a Federal tax return for each of the three most recent tax years...." What do I do? Should I check that box or just leave it blank??

Another question that I have is that I found all his W-2 and 1040EZ for 2007, is that the same thing as tax return form? and what the heck is 1099 form?

Well, let see, did or did your husband not file for taxes for the last 3 years... He if filed taxes for the last 3 years, then yes, check the box, otherwise do not check the box. Dont know how much simpler the question can be stated. If he filed 2008, 2007 and 2006 taxes (presuming those are the last tax years) then check the box..

Yes, 1040 and W2s make up the tax forms..W2s are what the employer sends out to the employee yearly and is used to declare the income for that particular job and 1040 is the income form used to file your taxes.

1099 forms are interest or dividends that must be added to the income if says the bank where he gets money deposited earned interest.

Dont know how much simpler the question can be stated. If he filed 2008, 2007 and 2006 taxes (presuming those are the last tax years) then check the box..

He only filed for 2007 but not for 2006, and 2005. He filed one out of three years That is why I am a little bit confused on that. So should I still check the box?

Well if he haven't filed for the most recent three years then don't check the box. But i think you need to provide a statement on the reasons why your husband haven't filed for 2006 and 2005..Yep! Just read the instructions now , it says in there if you're income is low and you don't have to file tax then provide a written explanation about this. :guides: of I-864 again. GOod luck

I suggest your hubby order tax transcripts for the last 3 years. They are free. Takes about 7 days. 1- 800- 829 1040.

Well if he haven't filed for the most recent three years then don't check the box. But i think you need to provide a statement on the reasons why your husband haven't filed for 2006 and 2005..Yep! Just read the instructions now , it says in there if you're income is low and you don't have to file tax then provide a written explanation about this. :guides: of I-864 again. GOod luck

I understand that we have to write an explanation why he didn't file for 2005 and 2006. It's just that little box that throw me off a bit.

One more question i have so if anybody can please be kind help me out one more time... so for 2007 tax information, we have W-2 and Form 1040EZ only, we dont have 1099 or anything other stuff. Would that be enough? or do I need to call IRS to get a transcript? If I do, does he have to be the one who calls..I asked because he is deployed right now so there is no way he can call from a deployed ship.

ANyway, thanks for you help once again! :)

THe husband haven't filed on 2006 and 2005 just the 2007

No matter as at least they will know what's on record and can deal with it with letters of explanation or whatever is necessary.

There's a number above that haole provide for a number to call for you to get an IRS transcript. IN our case, my husband and I just submitted a copy of his 2007-2005 tax, W-2 we didnt submit any 1099 form. You can call the number provided to ask for IRS transcript :thumbs:

So I will not check that box and write an explannation of why he didn't file tax for 2005 and 2006. According to Richo, it seems like I dont have to request for a tax transcript because you said that you only sent out a copy of tax and W-2 too...so I guess I will just do the same thing.

Tax transcripts are PREFERRED over ITRs and W2s. Since you are dealing with Thailand I suggest you have the most "power", ammo and your "ducks in a row" you can get.

THailand>? Isn't this AOS application and not k-1? Now im confuse :huh: Oh well :rolleyes:

On I-864 instructions part 6 no. 25 page 8 :P It says "You must provide EITHER an IRS Transcripts or a photocopy from your own records of Federal Income Tax Return for the most recent tax year" Its up to you what you want your husband's ITR to provide. GOodluck and blessings ^_^
