joint sponsor and tax return question

Timeline

I am in the middle of processing my AOS package for adjusting from marriage with my wife (USC). She still goes to college and works part time so her income is not over the poverty line. Currently she lives with me but in the last year tax return, she was filed as dependent. Her dad and mom total income is above the poverty line and they agreed to be joint sponsors (her dad individual income without the wife's is NOT above the poverty line). His and his wife filed the same tax return form (only 1 tax return form for both).

Please correct me if I am wrong:

- My wife will need to file an I-864

- Her dad will need to file an I-864 which lists ONLY her as dependent.

- Her mom will need to file an I-864 because she is one of the joint sponsors

- Her mom will also need to file an I-864A because she lets the husband uses her income to sponsor.

AOS (from F-1 Visa)

09-09-2008 - Package sent to Chicago lockbox via USPS Certified Mail

09-11-2008 - Package received at Chicago lockbox

09-15-2008 - NOA1's for I-765, I-130, I-131, and I-485

09-22-2008 - Received Biometric appointment (10/04/2008)

Mom only needs to complete an I-864A

The petitioner has to file for I-864 and if he/she does not meet the 125% poverty line, then get a co-sponsor who does and he/she fills out the I-864. Its that simple.

Yes, everything your co-sponsor sends, your wife has to send even if she doesn't make enough to fully sponsor you. If she works, she must have her income tax return, W-2s, etc., If she doesn't, at least write a letter explaining her situation and the reasons why she hasn't filed her taxes.
