Just a question. I can't find the right answer anywhere. What is the time limit of filing for the AOS? My fiancee received her K1 and arrived in the USA on August 16th from the Philippines. I know we must be married withing the 3 month period from the time her visa was stamped. But, when does the AOS have to be filed? Is it withing that 3 month period, or after we are married, then its 3 months from that point?

January 17,2008 - Touched

February 17,2008 - Touched

March 13, 2008- Touched again!

March 16,2008- Received NOA2 via email

March 19,2008- Left NVC, received case number. On its way to the USE in Manila

March 27,2008- Paperwork received at the embassy in Manila

May 7, 2008- Medical review at St. Luke. Additional tests required.

May 29, 2008- Interview postponed :(

July 23, 2008 - Finished Medical at St. Luke

July 28, 2008 - Interviewed at US Embassy

July 31, 2008 - Received visa

August 16,2008 - Fly to USA ( Portland, Oregon as POE)

September 19th, 2008 - Wedding

March 27, 2009 - Received Biometrics appointment letter

April 14, 2009 - Received a notice that case was transferred to CSC

May 1, 2009 - Touched

May 5, 2009 - Approved AP and EAD

May 11, 2009 - Received AP

May 12, 2009 - Approved AOS

May 14, 2009 - Received EAD Card

yes you have to be married within 90 days , but for the AOS there is realy no timelimit ,

its better if you do it soon , but i heard some people waite a year without problem

just remember your wife cant work or travel as long as she dont have the proper documents to do so

Just to clarify - the 90 day time starts upon entry to the US. Her I-94 expires 90 days later - to satisfy the K1 Visa, you have to get married within that time. You should do everything you can to file for AOS (adjust status) also within that time (before her I-94 expires) to keep her legal status.

As others have said, there really is no time limit but is always better to be in a 'pending' legal status, that 'out of status.' :thumbs:

While there's no time limit for AOS (that I know of), the medical done at the visa stage is good for only one year. If you send in your AOS application less than a year after you had your medical, you can save the cost and inconvenience of having that redone.
