I-864 - Husband has no income and no tax info?

Hi,

my husband and I mailed our AOS package out today, and I've been sitting here worrying about it of course. My husband doesn't work, hes a full time student. so, he has no income, however, he had a seasonal part time job last holiday season and he didn't file taxes because he said he didn't make enough; he only worked for a few months and it was like 10hrs a week (I don't understand how the taxes work in America, and I had my dad do them for me in Canada... so I'm clueless here) so we wrote $0 for income and we left the tax sections blank.

We have a joint sponsor but I'm wondering, was I supposed to give an explanation for why he doesn't have any tax info? (he has been a student for the last 5 years, and has been a dependent of his mom, the joint sponsor, since recently, and he's been lucky enough to have tremendous support from his parents).

Should I worry? will I get an RFE because of this? or will they just focus on the joint sponsors info?

any insight to this will be really helpful! Thank you!

Thats really rude... I didnt ask for criticism and we are not a spectacle that you can "bookmark... to watch". All I wanted to know was if this was a bad thing. we're young, its not like we have years of experience here. it says nowhere on the forms that if you have NO tax information that you have to file an explanation. I found out that "explanation" bit on the I-864 sticky thread here. On his I-134 we left his tax and income information blank and received no problems.

if you've got some advice or a similar situation that you would like to share, then I welcome it gladly.

as long as your husband has his joint sponsor, then not to worry but just prepare all the documents of his mom and so with your school records.. Some people here are so rude as if they have no problem to face. Its just that their situation is not like yours. God bless their journey... God moves in very mysterious ways.. Watch out rude people!

I think the worst that can happen is that they will send you an RFE for his tax info. If that is the case you can just write a letter to explain why he did not file taxes.

I don't think its something to worry about :)

From the instructions for the I-864:

25. Federal Income Tax Information.

... If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation.

You will likely get an RFE for this omission. Just be prepared with a letter written by him explaining that he was not required to file and the reason. If you don't need it, it won't hurt having been ready. It takes just a few minutes of time to write up a letter. If it's ready, then you can reply immediately to the RFE.

As long as you have the joint sponsor his lack of income should not affect your application. But USCIS does like all paperwork to be in order! :star:

I was in no way trying to be rude just wanted to see what people posted as a reply. You have a no income situation and mine is all wasted in payments to survive which lax anything additional such as foo etc. I am sorry if you took it as a rude reply and I apologize for it.
