Dear Abby,

Ok, so I pay taxes and do everything legal and correct since I became engaged to my fiancee Marina (k-1) in 2004, and now I receive this letter (attached) from the FBI regarding Carina's (k-2) AOS pending approval and I don't know who to trust anymore.

This letter was received despite my several written requests (USCIS, congressman, senator) for status, a phone call to the mis-information line to let them know SOMETHING IS WRONG with Carina's biometrics from December, 2004, an INFOPASS appointment on April 27, 2006 where I again advised the officer that something is wrong but am reassured that name checks can take years to process and we just have to be patient, AND a letter from USCIS Chicago district office Acting Director dated April 25, 2006 stating the name check results are not back yet, and to "be assured" that the file is checked weekly for results "to keep the adjudication process ongoing and timely".

I hope you readers will take a look at this letter and be sure to check if THEIR name check has been submitted at all. Tonight I start writing letters to the Chicago AD and officer who interviewed us as well as the USCIS Ombudsman and I'll be sure to include a copy of this letter with my correspondence. Maybe this time they'll get the biometrics right and/or let me know if they make a mistake before wasting our valuable time.

So sorry to hear of your trouble with your step-daughter.

My daughter's AOS went so smoothly, I was shocked. And she didn't even come to the U.S. at the same time as I did. She came later, so her AOS interview was much later than mine. Thank goodness everything went well. We'll see what happens when it comes time for the removal of conditions.

Good luck getting everything sorted out.

Thanks...I am trying to keep a sense of humor about it as you can see. My thought is what if I had just "let it go" and trusted that we were just one of those people where it takes years to get the namecheck back, when in reality the dumb thing wasn't even ordered at all?? This system has to be changed.

Honestly Dave, I received the same inconsistant information throughout our K1 security clearance. I was repeatedly told pending, ordered, please wait, call us in 60 days if you hear nothing to there is an error. Mr Hooten was of no use to me in that part of the process either.

Its likely that we won't be able to tell whats up from down when trying to understand what the $^@#&@ they are doing :lol:

Thank you for your updates. We are in the same boat. Interview last October and we were present with a lawyer who has been of no help.So we are also in that dreaded waiting for the FBI name clearance club.

We have written to our senator as well and they told me what we already know. Whether they will check to see if there is our "name" actually being checked by the FBI or not, I do not know.

I read that the fingerprints expire after a year or so anyway. Does this mean, We should contact USCIS and explain we are pending the FBI check, but the fingerprints were taken over a year.

You mention an ombudsman....sorry for my ignorance, but what and how do I contact ours as well??

Any help is truly appreciated.

They do mention the requirements below before submitting requests to the Ombudsman but I feel Carina meets those requirements since in essence we've been advised by USCIS that her background check has been submitted to the FBI and is "not back yet", but apparently in reality it hasn't been submitted to the FBI at all:

When You Should File a Case Problem with the CIS Ombudsman

If you have an ongoing or immediate issue with the USCIS, contact the CIS Ombudsman if:

You are facing, or are about to face, an immediate adverse action or impact, an emergency, or any other type of significant hardship, which is caused by an action/inaction/delay in processing by the USCIS, or a problem, which could not be resolved through the normal processes provided for by USCIS;

Your case experienced processing delays beyond anticipated processing times;

You will incur, or are about to incur, significant, and unusual costs (including fees for professional representation that are not normally incurred);

Have not received a response or resolution within the anticipated time frames as published by the USCIS;

The CIS Ombudsman cannot:

Adjudicate immigration applications or petitions;

Reverse an adverse decision issued by USCIS;

Serve as a substitute for legal options available to you to correct a problem; or

Provide legal advice.

I had the exact same problem with those bastards... you might want to file a Mandamus ( which is what I did while my fiel was transferred to CSC).
