I am filing for AOS for my wife now. On the affidavit for support do you include your former spouses income on the prior three years of income if you were married during that time? I have 2 years of filiing jointly and one solo year for the past 3 years and am wondering how to fill this out. THanks in advance

You are asked to enter the information shown on each year's tax return....which is a single number "Adjusted Gross Income" after deductions etc.

Sorry, but that's incorrect info. We are asked for to provide the TOTAL INCOME (not adjusted). If you use adjusted, you will be hurting yourself since that's usually lower than total income. If you are on the border, you may bring yourself down below the poverty line.

Sorry, but that's incorrect info. We are asked for to provide the TOTAL INCOME (not adjusted). If you use adjusted, you will be hurting yourself since that's usually lower than total income. If you are on the border, you may bring yourself down below the poverty line.

Right, it's line 22 on the 1040. You would declare the current income. For previous joint taxes, I'd only declare my own income, not the former spouse's. It won't match the total on a tax return but since a complete return includes the W2 and 1099 forms, USCIS can do the math.

Facts are cheap...knowing how to use them is precious...
