This is a question regarding the I-864 Affidavit of Support. I am in the means of gathering info for my AOS interview and I just have a question regarding the above. My husband use to run his own business with his father but as of early last year, due to some unpleasant circumstances, both my husband and I chose to leave the business and our residence at which we were staying. We left late June of 2005 and ended up moving in with his mom and stepfather up until the wedding. His employment has now changed since the last I-864 we submitted as has our address. We do plan on redoing another affidavit of support because of this to take to the interview with us just in case. I guess my worry is, even though he worked it out, that we might need a cosponsor.

He does make it over the poverty limit but there is a gap between jobs, will that affect us? Also since changing jobs though he makes it over the poverty line we yet do not have a savings account and our checking account has been flucuating drastically since some expenses have come up and we just bought a house. Will that affect us or do we even have to provide bank statements or is that only if we provide assets and we need to show proof? I'm worried about finding a co-sponsor if we need one and I don't have much time, does it sound like I need one? Can someone help please.

If you are over the poverty limit, you don't have to include your assets. And as long as his 2005 taxes show his income as over the poverty limit, you should be fine. Lots of people switch jobs and take some time off, I doubt this would be an issue for you.

I think you should be fine-just provide them with an updated version and include a letter which explains the gaps.

If you're over the limit, you're fine-no worries !
