Timeline

Again, white = rejection. But ours isn't so bad, as there is a reprieve per the instructions. My wife said there is also a blank white paper, which means "it's over." There's nothing on it, just a sheet of paper. I kept asking my wife about it but she said the consulate TV monitors explain clearly what the various colors mean, including a white sheet of paper. She said she almost fainted when she saw the back of our paper (blank) and then was happy to see the writings on the other side.

She faxed it to me so it's not a good copy. The blue is my own highlight.

April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit

Q: Should I be there in person to turn in the material, in addition to requesting them to talk to me? (I would have to quit my job because I can't take off right now.)

Q: Should I also submit photos and other things that support our relationship that was never examined by the dude at the interview? --the dude didn't look at anything.

Q: If in my shoes, would you hire ME?

Lastly, please give me your honest impression: do you think I have a chance in hell to pull this out of the fire?

Hey bro,

i was in the same situation before only my fiancee got the blue slip on her first interview. I was also devastated after finding out from her that she did not get a visa. They basically asked us the same thing, the notarized timeline of our relationship plus information about my ex-spouse. So instead of focusing on being upset about the whole thing, i focused on what i need to do to get that pink slip. So i got the documents they asked plus i gathered all the evidences i can get since the time i met her until the present time (e-mails, chats, letters, cards we sent each other, phone records etc.) Then, i booked a flight back to VN last Aug. 21st and personally hand carry about 15 lbs of evidence. As soon as i reached VN, i ran every information i wrote : the timeline, my ex-spouse among other things with my fiancee. And on Aug. 23rd, we went to the US Consulate in HCMC to submit all the documents i had. I did not go with her inside but i instructed my fiance to let them know right away that I am in VN at that time and if they need to talk to me, i will be more than happy to do so. Anyway, to make te story short, they looked at all the evidence and after 4 hours of waiting, they finally interviewed her for about 30 minutes. They asked her a lot of questions about me and she thought they will call me coz the consulate asked her if they can talk to me. But they never did. They issued her and her son their visas. We picked them up yesterday and our flight to Los Angeles will be this coming Tuesday, Sept. 9th.

for now, i think as long as you have all the documents they asked (and more) you gonna be fine. It will be better (I think) if they know that you personally took all the documents to VN but try to see them only if you still fail to get the pink slip. And lastly, i personally feel that after submitting all the required documents, you will get what you aimed for so stop worrying and start working on your plan of attack..

I will also pray for your success for i know how it feels.

Don't forget you're financially RESPONSIBLE for her, per your signature in the I864/I134 forms (translating, Jobs, Jobs, Jobs)

To hire ME or not, only your pocketbook can answer that. The reason you chose to do so in the first place (gambling on NOT having an attorney) is because you did NOT value your love for her as much as it could be. If you gamble, you might win or lose.

Think about it, if everyone gets the pink slip, how you suppose all the airlines and lawyers make a living?

An attorney assures you of nothing, not even in HCMC. To judge someone else's love and relationship based on the fact that they did not hire an attorney for the process is ridiculous.

Many couples have been through this at this Consulate. You have only to venture through posts in this part of the forums to find that out. It's not the end of the world, it's a request for more evidence. Be thankful it's not worse. ;) Learn from the others that have been in your shoes and follow their lead.

An attorney assures you of nothing, not even in HCMC. To judge someone else's love and relationship based on the fact that they did not hire an attorney for the process is ridiculous.

Thanks KimandRuss. That comment on not valuing the love because of lack of not hiring a attorney was to me very strange. It was like saying that we have to BUY our love. If the others here have said I needed anything even a lawyer then I will get one. I am in the process of gathering all the paperwork and evidences now and may need some info and plan on finding it here there or anywhere and alos bug people here for it. Then I will do it.

If I had to buy someones love then I will just stay single.

A word of advice to the one that said it. If you had to buy this love then I assure you that person will not be there for you in the future. Money or no money.

Your white paper requested documents are very standard when they have doubts about your case.

I do not believe that going back to Vietnam and meet C.O. will make any difference. I'd rather send them emails and discuss your concerns.

You should submit photos that REALLY shows you two have been together for some period of time. You can show this by picking out pictures with different hairstyle, skin textures of the people on the pictures.

If you have emails/letters, picking out the ones that you two discussed about marriage, futures, plans...etc

I cannot say anything about hiring M.E. or not. I don't know your red flags. What would be a reason for the C.O. give your spouse a white paper?

Last advice about timeline, please make sure you have everything match up with what your spouse has said at the interview. You do not want them to use that against you.

First of all, thank you, everybody. I really appreciate the support and advice I've received. We're working hard to resolve our case. But I just want to show you what's going on with this consulate:

I sent them an e-mail right after the interview and asked for clarification. This is what I got after the weekend:

Dear Sir,

A consular officer interviewed your wife for an immigrant visa on September 5. Her application was denied under Section 221(g) of the Immigration and Nationality Act (INA), which states that applications lacking required documents must be denied until such time as those documents are submitted and found to be sufficient. He/she was asked in writing to submit any evidence of communication she has from 2006-2008. She should not submit evidence submitted at the time of interview.

Also, you were asked to provide a notarized explanation letter of the timeline relationship between you and her; as well as the information of your ex-spouse. <--I DON'T have an 'ex-spouse!' Are they even looking at my case when they communicate with me?

After gathering the requested documents/information, your wife may submit the additional information either via registered mail or in person at the Consulate between 1:00 p.m. - 3:00 p.m. Monday through Friday, except holidays. She should include the OF-194 refusal sheet that She received asking for additional information.

This is common practice at HCMC. Have a look around the forum you posted this in and you will find loads of other posts relating to all the same requirements. I think someone has even posted a format for your 'timeline' before. Just do a search.
