SSN after Marriage before EAD?

Hey there,

I have this little problem and I hope that there is someone in this forum who can help me:

I got married a few days after arriving in the US on a K-1 visa. We filed AOS right the next day in order to receive the EAD as soon as possible. I didn't get a SSN before the marriage and now that the AOS is pending I apparently need the EAD to receive a SSN.

I went to the Social Security Card Center today and one of the officers told me that I can go to the USCIS and ask to get a I 551 stamp in my passport. That would be proof enough (that AOS is penidng) and I could come back to the Social Security Card Center to apply for a SSC even before the EAD arrives.

Does anyone of you know if this is at all possible? I mean, to receive a I 551 stamp just like that?

I'd really appreciate your help or experience since I would like (and need to) start working right when the EAD arrives.

SSA is wrong.... USCIS will not put an I-551 stamp in your passport because you are not yet approved ....

You can get a SSN until day 76 after entry in the US as a K-1... you might find it easier to apply in maiden name with no mention of marriage and then change it later...

Or can I just not tell them that I am married already? Wouldn't they somehow find out, though?

sorry, so many stupid question. It is all just so confusing (and doesn't make sense at all!)

Your K-1 visa is dead but your K-1 status is unchanged regardless of your post entry marital activity....... It does not change until you adjust your status via an I-485...

regarding marital status, how would they find out unless you told them?

I applied SSN with my married name before my 1-94 expires without questions . They only asked my original Marriage License and my passport then photocopied them and gave it back to me. They said it took 4 to 6 weeks to process it since they need to verify my documents because I changed my last name. I got it in the mail after 5 weeks.

I hate the fact that even the people that work at the SSA don't know too much.

I tried to find some official links to print out, but couldn't find any. Does anyone of you know a good official link?

Exactly...the otherwise helpful customer service folks at SSA are not too well informed, and can be very nervous while under government pressure not to issue SSNs to immigrants who are not quite "legal" yet. You can try again & get a different clerk. Many married women go by their maiden names for professional or other reasons, so your last name is irrelevant. But if the application asks if you are single, don't fib. It will catch up with you.

Well, actually I did. And I see that the K-1 holder doesn't need specific DHS authorization.

BUT... when I scroll down to section C2 it says on the bottom that adjustment applicants need one.

And after filing AOS I am a adjustment applicant or not?

That would give them right somehow or no...

Myself as well. Applied for my SSN a month after getting married. Got the card in 8 days. Many workers in the Social Security office do not understand visa status when it comes to K-1.

SSA experience part II:

FRUSTRATING! Taking the OIG and POMS I thought I would have enough proof that I can obtain a SSN after marriage but far before day 76 of my I-94 expiration.

Apparently not.

I argued about 15 minutes with the clerk and her supervisor but they were persuaded that since I was married my visa status would be K-3 or at least it wouldn't be K-1 anymore (since I am not a fiancee anymore).

It was so frustrating. They said the expiration of the I-94 would just mean that I had to get married before that date.

At some point I gave up.

So now I have to wait till I get my EAD. Apparently I can start working without SSN and take a receipt to the employer. That is at least something.

If I had known before I just wouldn't have told that I am already married.

The pragmatic approach would have been to not acknowledge the marriage having occured, and applying for the SSN in the previous name....
