We went for an info pass and they put in a service request for EAD, but nothing?

How long does it take to get EAD when they say they are going to order the EAD?

How long does it take to get EAD when they say they are going to order the EAD?

from what I've seen on other people's timelines it looks like about 2 weeks or so

probably you'll find it in ur mailbox as the e-mail system doesn;t seem to work

Yea, I keep checking, but nothing. I would just like a touch. I thought there might be touch since we had our info pass. It is frustrating since they told us there are no holds on it.

Yea, I keep checking, but nothing. I would just like a touch. I thought there might be touch since we had our info pass. It is frustrating since they told us there are no holds on it.

I know the feeling... I have almost 80 days since filing and getting ready to schedule the infopass...

I wish I would understand the way they select the cases for EAD processing and such....

they don;t seem to make any sense...

Making an infopass appointment for an EAD that is past 90 days of processing may very well result in a request to the NBC for processing to be completed and for the card to be mailed out, but I'd strongly advise people not to hold their breath. More likely than not the request from the Local Office will have no impact on the processing time. It's not like the card is just sitting on a shelf waiting for someone to ask for it to be mailed. The card will be produced when the application has been adjudicated on, not when a Local Office requests it.

I know it's frustrating to see your application take longer than 90 days when others take less, but that's just the way the game works. Each application is different, and yours wont be the same as someone else's who got theirs in 50 days.

Where does it say that, and are you sure it's for category [c][9] EADs and not for another category?

I think that 90 day frame is for EAD in all catergories right? :unsure:

Code of Federal Regulations §274a.13.[2].[d] states (relevant information formatted and case adjusted for ease of reading):

"[d] Interim employment authorization. The district director shall adjudicate the application within 90 days from the date of receipt of the application by the INS, EXCEPT in the case of an initial application for employment authorization under §274a.12[c][8], which is governed by paragraph [a][2] of this section, and §274a.12[c][9] in so far as it is governed by §245.13[j] and §245.15[n] of this chapter. Failure to complete the adjudication within 90 days will result in the grant of an employment authorization document for a period not to exceed 240 days. Such authorization shall be subject to any conditions noted on the employment authorization document. However, if the director adjudicates the application prior to the expiration date of the interim employment authorization and denies the individual's employment authorization application, the interim employment authorization granted und er this section shall automatically terminate as of the date of the director's adjudication and denial. (Amended 7/1/94; 59 FR 33903) (Amended 1/4/95; 59 FR 62284) (Amended effective 6/22/98; 63 FR 27823) (Corrected 7/21/98; 63 FR 39121) (Amended effective 6/11/99; 64 FR 25756) (Amended 3/24/00; 65 FR 15835) "

So, USCIS is legally bound to adjudicate EAD applications within 90 days except for applications under category [c][8] (adjustment applicant - they have to be done within 30 days) or for applications under category [c][9] (adjustment applicant - no time limit stated in law for those).

If you file your I-765 and your category is [c][9] then like I said, don't hold your breath. There is nothing realistically that an infopass appointment can do. It takes as long as it takes.

Granted, the text of I-765 is a little misleading as it only differentiates between category [c][8] and everything else. It doesn't specify the rules for [c][9] but at the end of the day USCIS follows the CFR and INA, and that does differentiate.

How long does it take to get EAD when they say they are going to order the EAD?

A friend I'm helping had EAD Infopass appointment last Tuesday and got the EAD in the mail today.

VERY fast! Especially for Hawaii!!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
