Hello Everyone,

So after waiting, I finally got my RFEs in the mail. It is an item that is needed I guess for all the forms and it is my I-94. I am a canadian citizen and when I enter the United States I have never gotten an I-94 and even this time, I entered as a visitor and they I wasn't issued an I-94 because I planned to just go on vacation and come back home. So anyways, i sent a copy of my passport page and the stamp they stamped on the page to grant me entry and I sent it back. In any case I don't think I will get my EAD before my interview on February 10 so I guess if they need anything else they will let me know at the interview.

So that is what the RFEs were for. I had even sent them 3 copies of the passport but they asked for I-94 or a visa and I don't have any because I entered on the Visa Waiver Program. Lets see what happens.

Did anyone out there enter from Canada with I-94. I know if you go with the spouse visa you are given an I-94 right? but i never seen one that enters as a visitor get an I-94

Woooww... that stinks, Time. Sorry to hear about that.

Regarding the I-94, i was under the impression that all non-usc's are supposed to fill them out when entering the country...even if you enter on VWP or on another visa. Wish i could be more help... but all my bosses are non-usc, here on VWP and on other visas, and they all have I-94s stapled in their passports.

Hope someone comes along soon to answer your question. i thought there was a form you had to fill out if you lose your I-94, or in your case if you never received one.

I just came back from my infopass. It was not very helpful. The lady called the NBC and ask about my case, and they say someone is dealing with it now and it's approvable but it can take still to 2 weeks before I get approved...I don't understand why it takes so long!

About my AOS, it's really weird, because on Monday on the phone USCIS told me it had been sent to Denver, but in Denver they told me it was still in NBC...

Oh and the lady told me to that I will probably get my AOS interview May or June...

Hopefully it will be approved soon, now that you put a fire under their buttocks!

Have no idea if it applies to you or your case. Maybe post your question as a separate topic so more people can answer? Or call the mis-information line to find out if you need to address the issue of the I-94?

Hello Time,

If you came by Air you were supposed to collect it from the airline you used before going through the airports on arrival, you fill the form and the bottom perforated part is given to you, if you drove down maybe you could have collected it at the border... i dont know how that works, but there are provisions for that, and i think you ll find informations about replacing the I-94's on uscis.gov, it also would direct you on what to do if you didnt get one on arrival. Its better you look into it and see if you can get it before mailing back the rfe's, I'm sorry, i know how disappointing this is for you.

Someone also had this problem and was treated here on visa journey, this is the link to it, i think you have to go to the airport you came through and you ll be issued a replacement form.

A girl came into my work today, and when I asked for her driver's license as ID, she handed me a Permanent Resident Card.

I could have cried, seriously....

And now our wonderful President-Elect wants to grant amnesty to all the illegals who sneekily avoided this whole clusterf&*k??? Yeah, not so happy here...

thank you so much for your help. As a canadian citizen whenever I have visited the U.S. I have never been told to fill out an I-94 unless you are coming here as a student or coming to do business or for a job. As a visitor they just stamp your passport that you have cleared inspection and you go on with your visit. When I called USCIS, the representative told me as well that you entered on Visa Waiver Program and you don't need one because you are a canadian citizen. So she told me to just send the copy of the stamped page again and that's what I did. But I doubt they would give a letter of Aos interview if it were an evidence they needed to process my file. They sent my interview letter way before they sent me an RFE so I guess if they need me to fill out the form AlHayat kindly looked up, they will tell me at the interview.

US-VISIT Biometric Procedures: Applicability to Canadian Citizens

Most citizens of Canada are not subject to the US-VISIT program, including:

* Canadian citizens who are visa-exempt.

* Canadian citizens traveling on Canadian passports with diplomatic visas or visas for international organizations (A, G or NATO).

* Canadian citizens who are studying or working in the United States, who normally do not have non-immigrant visa in their passports.

* Canadian citizens who are permanent residents of the United States.

* Children under 14 and people over the age of 79.

* Applicants for admission at primary vehicle inspection presenting a valid, unexpired, multiple-entry Form I-94 may be admitted without being subject to secondary inspection even if the applicant is not yet enrolled in US-VISIT.

Note: Customs and Border Protection Officers retain the discretion to refer a visitor for US-VISIT processing as part of the inspections process if there is a concern about the nature of travel.

Canadians who are subject to the US-VISIT program include:

* Citizens of Canada applying for admission with a non-immigrant visa such as Canadian citizens with K visas (fiancés) and E visas (treaty trade investors).

* Canadian permanent residents. Under U.S. regulations, Canadian permanent residents are identified by their citizenship (i.e., the nationality of the passport that they carry), not by the fact that they may be permanently residing in another country such as Canada.

* Canadians with dual nationality who present a non-Canadian passport when seeking to enter the United States.

okay, so i am seriously confused here. i thought that people with case transfers to csc were supposed to get their greencards FASTER than those with interviews...am i missing something here? misinterpreting? i dont get it. congrats to all of those who have recieved theirs, but i find it odd that not one person with a csc transfer has been approved yet.

actually thats what ive seen as a trend too then...but seems like people who have interview date are the ones who got approved faster now..looks like CSC is working slower nowadays...
