Hi friends.

No great news on my AP or EAD so far....

I was surfing the CIS ombudsman's website yesterday.

I asked ombudsman for his/her help when my K1 petition was pending forever.

Since I found bunch of similar cases on VJ and elsewhere, I thought there may be something related to EAD pending over 90 days on their website.

Then, I actually found an article about EAD pending more than 90 days.

If your EAD is pending more than 90 days, please read this.

http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm

The post is from Sept. 2008, so it is fairly new.

When I asked for their help for my K1, they could not get back to me fast enough (my petition was already approved when they got back to me.).

But, regarding this matter, they have an e-mail address specifically for EAD pending over 90 days. (For K1, we had to fill our forms which are used for all the other type of Visas.) (Other articles show that they have been warning USCIS regarding their inconsistency on EAD processing.)

So, you may want to follow the direction and try it.

They want the name and number of the operators who are telling you bullshit. They also want the time and date you called and talked to her/him. "The law" requires USCIS to process EAD within 90 days. On the article, it says you are supposed to hear something regarding the service request within a week.

Anyway, I am not sure whether this helps us or not.

But, let's hope it works and give a try. Let's tell them how USCIS has been treating us. :star:

The only way to change this for us and for the others on the way is to tell them what is going on. :star:

Nao

Hello friends. :star:

I was researching in depth on what kind of response people have gotten for contacting an ombudsman.

As far as I see it, it worths a try.

It seems that ombudsman will contact you by e-mail a few days (seems to take about 2-3 days) after you send them an e-mail.

They will tell you that they will look into your case and try to push an approval.

Then, they will tell you to contact them if you do not see an approval within a week.

They will keep contacting you till you finally see an approval.

So, let's give a try. :star:

Oh... do not forget to include your information when you send them an e-mail.

I think you should include:

Your name

A#

EAD case # as well as AOS and AP case#

(Just write that concurrently filed with AOS and AP so that they can see your situation better.)

Contact information

EAD received date on NOA1

Biometrics date

Do u have any other suggestions?

Nao

I hope we will both get it by the end of the week! and I hope you'll be with your daughter for the holidays!! :)

I heard that Boston is one of the busiest local office. Before I got laid off, our office has an immigration attorney. She knows roughly when I submitted my papers, and she estimated that my EAD and AP will come around now or first 2 weeks of January, then the interview should be around Feb or March... hope it won't be that long in practice!

Hi everybody ...Just wanted to know what exactly are you supposed to tell the USCIS when you call because it is 90 days that they received the work and travel authorisation applications and that you didn't hear from them?

They received everything from us on the 15th of September, neither the AP or EAD were touched, only the AOS was, first for an RFE and then for transfer to CSC.

We plan on calling them by the end of the week, I am getting crazy at home, I really need to get my EAD so that I can do something...I actually had to decline some work opportunities because I don't have the EAD

Hope everything moves for everybody

PLEASE!!!! It's Christmas, be quick and nice !

Anne-Lise

Hi Anne-Lise,

Tell them directly that it has been over 90 days since you filed for your EAD, and you would like to request an expedite or a possible interim EAD. The next time i call (altho... i hope i don't have to call again! :innocent: ), I am going to take down their name and employee number (as suggested in Nao's link)... I believe they give it to you when they first take your call.

Good luck!

i really hope none of us have to call USCIS anymore... at least not regarding the EAD.

Hello. :star:

As far as I know, they used to issue an interim EAD at the local office. So, basically, we used to be able to get an interim EAD on the same day. But, they no longer issue it at the local office.

What they do now is that officers at the local office determine our eligibility and order it to USCIS for us.

So, I think they still issue an interim EAD. :star:

I will ask them when I go to an infopass appointment next Monday and let you know what they say.

Nao

Hi Nao, my friend-in-waiting,

Yes, i think that is true. They can no longer issue you the EAD on the same day... but hopefully they can help get it moving. Isn't that a bummer, they can't issue you an interim right on the spot? :protest:

Interestingly enough, i was looking at the infopass appointment receipt (the one with the bar code)... It actually reads, Appointment Type: Interim EAD. Does yours say that?

Good luck! :star: :star:

Hi AlHayatZween.

Yep. It is a bummer that they do not issue an interim EAD right on the spot.

Mine also says Appointment Type: Interim EAD.

It is so lame that the appointment type is Interim EAD and they cannot issue it on the spot....

I will ask them to expedite my case and also ask to order an interim EAD on my appointment.

I will see what they say....I hope it works. :star:

But, if it doesn't work, I will send an ombudsman an e-mail with all the details.

Then, if it still does not work, I am ready to go to an infopass appointment every single day. hehehe

i know.. im an industrial engineer..

the reason why im tryin to get an entry level job is cos i know people wont hire me cos i dnt have exp here in the US..

and it sucks that even at a secretarial job they'll be askin me for that f*ckin history..

how am i gonna have that if nobody wants to give me a chance.. meye.gif

.

hi envy_me, don't sell yourself short. A college degree is a big thing in the US, even if received from a foreign country. Don't waste it by doing something 'entry-level' and unrelated. I suggest that you still apply to positions commensurate to your qualifications. Include in your resume any work you've done outside of the US (especially if you've been working for a long time). Even if you haven't worked a long time, you can show your qualifications. Think of it this way, you're just like any other fresh US college graduate who's working for the first time in their field. These college graduates don't go and work in unrelated fields.

If you do decide to apply for an 'entry-level' job, think of it as a stop-gap measure of getting some income while you actually hunt for the job appropriate for your qualifications.

Good luck!
