Hi all,

I went to ask what I needed to apply for a Drivers License the other day and was told that, as well as my SSN, Birth Certificate, Passport, I-94 and proof of MS residence, I would also need to bring my INS papers. I have no idea what my INS papers are but the woman said I had to bring them.

Can anyone shed any light?

"INS" is the acronym for "Immigration & Naturalization Service," which (I'm 99.44% certain) was folded into the Department of Homeland Security when the latter agency was formed. Besides your passport & I-94, it's unclear what other "INS-type" papers you might need to bring. Consider going back to the D.L. office and talking with someone else (or even the same lady) for clarification. It sounds as though they're already asking for documentation that should satisfy any reasonable person.

Also (and perhaps do this first), check the State of Mississippi's website to see what you can learn.

If you receive conflicting or confusing answers, consider phoning the State Dept. of Transportation (or similar name) in Jackson. A clerk or supervisor there could clarify the rules.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Your INS paper is your legal status in the US, which will be an unexpired I-94. Otherwise, an EAD or your Green card will be your INS papers.

In their website, as copied and pasted below (coz I know how to use google.com and type "Requirements for Mississippi Drivers License" :dance: :dance: )

Non-U.S. Citizen Information

If you are a non-U.S. citizen, you must meet all other requirements for obtaining an operator's license or identification card except for providing a social security card. The license or identification card will be valid for one (1) year from date of issuance.

You must present valid immigration papers, including a birth certificate (translated by a state run university), passport, I-94, proof of domicile and alien resident card (if you have one).

Regular Class R Driver License

You are eligible if you are fifteen (15) years six (6) months of age or older and held a Learner's Permit for a minimum of six (6) months.

You must provide the following information:

1. A completed, signed Application form. If under 18 years of age, the parent's signature must be notorized.

2. A social security card or a printout from the Social Security Administration. (Note: metal social security cards are not acceptable.)

3. A certified copy of your birth certificate. (Note: Hospital certificates are not acceptable.)

4. If under 18 years of age, you must show proof that you are in school by presenting a Certificaiton Of School Attendance form obtained from the school that you are attending. (Note: This form is not valid if over 30 days old. )

You must pass the driving skills test. This may be waived if you are over 18 years of age and have held an out of state license for a least six (6) months.

You must pay the appropriate Fee - cash only.

You must provide Proof of Domicile (see policy below).

Driver Services Policy 7-1A: Proof of Domicile

State Statute 63-1-19 (1999 Legislative Session)

Effective July 1, 1999, any applicant for an original license who is over eighteen (18) years of age must show proof of domicile in this state to receive a license. No post office box number may be used as evidence of domicile. Any proof of documents must obtain a physical address. The examiner shall note on the application the type documentation used to determine domicile. Applicants under 21 years of age may use documentation that applies to their parents' domicile.

The following evidence or other reliable evidence may be considered in establishing, but is not necessarily determinative of domicile. Proof of domicile must be in the applicant's or applicant's spouse's name, or in the event applicant is under 21 years of age, their parents' name.

1. Electric Bill

2. Water Bill

3. Lease or Rent Agreement

4. Car Tag Registration Receipt

5. Mortgage Papers

6. Homestead Exemption Receipt

7. Bank Statement with Physical Address (no blank checks accepted!)

8. Notarized employer verification on their letterhead stating address of applicant (must include phone number)

9. Mississippi license issued to parent or legal guardian when applicant is under 21 years of age.

NOTE: A new Mississippi resident who presents a valid out-of-state license is no longer required to take a written or skills test. See Frequently Asked Questions (FAQs) for requirements.
