I-130 approved 8/11 and sent to NVC~K-3 approved today?

We are happy, I think?

Our I-130 was approved 8/11 at CSC. It was sent to NVC and received on 8/22 (according to the nice folks that answer the phone there).

We have been calling daily, waiting to hear that our I-130 was received and that they are generating a bill for the AOS.

Today, we got notice that our K-3 has been approved....

We don't know what to expect now. There is no one that we can see that has a timeline like ours. Is there anyone out there that has experienced the same thing? Any ideas on how the NVC will proceed? Does anyone know if NVC has guidelines on which application it will process when it receives both applications?

I think I am loosing my mind... :blink:

This has been happening quite a bit lately at CSC. If I understand the process correctly, you now have 3 choices.

1. K-3: Ignore everything from NVC, and just let them send the K-3 to the consulate.

2. IR-1/CR-1: Follow the NVC procedures. Use Loto's guides, and you can get through there in 6 weeks or less.

3. Go for both. More than likely your spouse will get an interview date for the K-3 first. I have seen cases where the IR-1/CR-1 catches up at some point, and then you can ask for the interview to be changed from K-3 to IR-1/CR-1 at the consulate. Not sure how your consulate handles this

Keep in mind the IR-1/CR-1 is a much better visa. You will be able to work and drive right away. There is no adjustment of status (I think the fee for that is $1010.) If you've been married for over 2 years at POE, then you wont have to deal with USCIS for 10 years, or until you decide to file for citizenship. As far as time goes, it is just the longer NVC processing. If I have the choice, I am going the IR-1 route. After seeing how much fun it is waiting for USCIS, I don't want to deal with them for another 10 years.

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

K-3 is a visa... It has not been applied for or approved yet. Your I-129F petition was approved. It is important to maintain this subtle difference as advice will be quite different dependant on what stage of the process you are in.

u can try to call for an interview sched for k3 visa since ur approved on that one already..$1010 doesn't really hurt much if u want ur wife to be home fast..

We agree, at this point, the money is not the deciding factor for us, time is...

We are going with the K-3 visa (which is obtained with the I-129 form :P )
